Bare-Breast Teen in Video Game Sues to Stop It

HOUSTON (Reuters) - A Texas teenager shown bare-breasted on "The Guy Game" video game has sued its designer and distributor and manufacturers of the machines on which it is played in an attempt to halt further sales.

 

A state judge agreed, at least temporarily, and issued a restraining order this week to block further distribution by game designer Topheavy Studios.

 

Also affected by the order were distributor Gathering of Developers Inc., a unit of Take-Two Interactive Software Inc. (TTWO), and console makers Microsoft Corp. (MSFT) and Sony Computer Entertainment America (a unit of Sony Corp. (6758.T)).

 

The plaintiff, whose name was not revealed in the Austin, Texas, lawsuit, says she was 17 when she consented to a revealing appearance before Topheavy's cameras as part of spring-break revelry at South Padre Island, Texas.

 

 

She says in the suit she was promoted as one of more than 60 "actual Spring Break Hotties" who posed for game developers at South Padre Island, Texas' top beach destination for college-age fun-seekers.

 

 

Under state law, attorney Jim McClendon said, the girl could not legally consent to her appearance because she was a minor. She seeks monetary damages and a stop to game sales.

 

 

"We're just trying to nip it where it is now," McClendon said. "We don't want anything else distributed with her image on it."

 

 

Topheavy did not return telephone calls seeking comment. Take-Two and PlayStation 2 maker Sony declined to comment.

 

 

Sean Marshall, spokesman for Microsoft's Xbox gaming platform, said in an e-mail, "Given that we are not the developer of this game, we suggest that you speak to the company that did create the game for comment."

 

 

The lawsuit says the girl appears topless in the game as a reward for successful answers to trivia questions. Her breasts are exposed in a manner that is "sexually suggestive, lewd and lascivious," the petition said.

 

 

Her voice also is heard on the game, and her photo and real first name -- which was not listed in the suit -- appear on the game's Web site, her lawsuit said.

 

 

McClendon said he is open to resolving the matter without a trial.

 

 

"We are trying to reach an expeditious settlement of the matter now that we know what's going on," he said.

 

 

The game was rated M for "mature." The Entertainment Software Ratings Board reserves its strictest rating AO, "adults only," for more sexually explicit fare.

 

I'm appalled those vicious game developers took advantage of this poor young girl when she didn't know any better!! I hope she sues the pants off them and they can never make games again!!...

 

Well, I was joking about part of that, anyway.

 

The funniest part is trying to sue the manufacturers of the systems.

This is comedy on MANY levels.

 

1) she illegally consented to show off her body to cameras (since she was a minor and did technically "give consent")

 

2) if the developers did not know of her age (or if she lied) then while they do have to take the game out of circulation and edit it up, they are not really the ones at fault, as they believed that the person they were putting into the game was actually 18+.

I'm all for suing the makers of incredibly shitty games.

Normally I'd agree, but I don't think the game actually made all that much money and it's rewarding a stupid greedy bitch, so I'm a bit torn.

 

Rando: probably, assuming that's precedent on an issue like this. I'm curious how the idiot game makers let this happen, though. Fake id?

 

Hopefully somebody sues the makers of Playboy: The Mansion.

And you don't even see titties until you spend a lot of time with the game. The reviews I read said at first the game's logo covers the good stuff, then after a while they are blurred, and THEN there is nudity. Talk about artificially extending the gameplay.

 

The Playboy game actually doesn't sound bad. It's pretty much like the console version of the Sims, with goal-oriented gameplay, and being able to shoot your own pictorals sounds decent.

If they go to court, there'd be a bitch that sues others to cover for her own stupidity, some developers of a bad video game, and some bloodsucking lawyers under one roof at the same time.

 

Is it too horrible for me to hope the court building just happens to collapse during that particular hearing?

The Playboy game actually doesn't sound bad.  It's pretty much like the console version of the Sims, with goal-oriented gameplay, and being able to shoot your own pictorals sounds decent.

Except:

 

a) There are already plenty of Sims games out there.

b) The nudity is the main selling point, and it's only bare breasts anyway.

c) The developers expect the players to have the attention spans to do the Sims stuff to see the nudity. Yeah, right.

d) You're going to pay anywhere from $30-$50 bucks and invest gameplay time to see b00bs when you can buy an actual Playboy and see b00bs for...I don't know, 5 bucks right? Fucking retarded.

e) I think it's actually polygon b00bs anyway.

 

It's going to be 3rd-rate version of the Sims. Whoop. What loser would buy that piece of shit? There *are* console versions of the Sims out already.

If you play the Sims on the PC then you can already do all that. There are many skins that show boobs, pussies, and cocks without being blurred.

Next saturday night, this girl from The Sims is having a birthday party at her Sims house. Her best Sim friend is my girlfriend on The Sims, Shelby. Me and Shelby have been together for 5 weeks on The Sims, and I know it's the perfect time to "do it" in The Sims. I mean, we're both goin to upgrade The Sims soon and the girl's parents won't be online for the party. "Next Saturday" in Classic Threads. I don't remember the ending, just that we were constantly getting updates from the party. This was before RSS feeds were the in-thing, so it was a big deal.

All the bashing of the chick was kinda weird. I don't see any mention of her asking for money, just seemed like she wanted to stop the game from being distributed. Although it's a bitch move to show her tirts and only complain about it months later, that doesn't change the fact that the game developers are the ones who are legally responsible to make sure that their game doesn't inadvertently feature child pornography. I mean, talk about an oopsie. Girls Gone Wild got cockslapped over the same thing, after all. Anyone know how this suit ended up?

A PC, PS2 and Xbox-based trivia game has been banned in the US after a teenager alleged that the title contains topless video pictures of her, used not only without her permission but filmed when she was a minor.

 

Called The Guy Game, the software poses the player with a range of trivia questions. Answer them successfully and you're shown shots of young women cavorting on beaches, usually in a state of undress.

 

The plaintiff, who remains unnamed, took the game's developer, Austin-based Top Heavy Studios, and its publisher, Take-Two subsidiary Gathering of Developers, to court on the back of her allegations, and this week was granted an temporary injunction banning the game from sale.

 

The teenager claims to have suffered humiliation, embarrassment and shame as a result of her alleged appearance in the game, which went on sale in the US in the summer, offering piccies of "over 60 smokin' coeds" and "real video of actual Spring Break hotties". Women "proudly show off their 'assets' for your personal enjoyment", runs the game's spiel.

 

Unfortunately, the footage of the plaintiff was taken when she was 17 years old, she claims. That not only renders the content illegal, but her status as a minor negates any consent she may have given to the game's developers to take and/or use the material.

 

"The plaintiff is still a teenager and wishes to attend college, develop her career and be active in her community and church," the lawsuit said. ®

I believe LooneyToon was one of the post-banning names used by BBCW, who eventually quit posting here and took root for a time at the green board before disappearing altogether
