(AP) - Detectives illegally seized photographs allegedly showing R&B singer R. Kelly having sex with an underage girl and prosecutors cannot use them to try him on child pornography charges, a judge ruled Thursday. Circuit Judge Dennis Maloney agreed with Kelly's lawyers that Polk County sheriff's detectives did not have enough evidence to justify a search of Kelly's Davenport home when they asked a judge for a warrant in June 2002. The photographs were on a digital camera that was wrapped in a towel inside a duffel bag. Prosecutors said they would wait for Maloney's written order to decide whether to appeal. Assistant State Attorney Chip Thulberry said if there is no appeal, prosecutors would drop the 12 counts of child pornography against the singer, whose real name is Robert Sylvester Kelly. Kelly's Chicago-based lawyer, Ed Genson, called the singer, who was not at the hearing, and told him the evidence was being thrown out. ``I told him, `Congratulations.' He was very pleased,'' Genson said. Kelly also faces 14 counts of child pornography charges in Chicago and has pleaded innocent. Those charges are not affected by Maloney's ruling. Last month, seven of the original 21 child pornography charges against Kelly in Chicago were dismissed. Ron Toward, a member of Kelly's defense team, told Maloney the search warrant affidavit submitted by Polk County Detective Robert Mateo lacked the evidence needed to form a legal basis for a search of Kelly's home. Deputies had earlier found marijuana in a home Kelly rented for three business associates. They then sought a warrant to search the house where Kelly was staying nearby to look for drugs. During an initial search for drugs Mateo said he observed video cameras and an ``unusual'' amount of adult pornography in a cabinet in a room marked ``Private.'' The detective then sought a second search warrant to look for child pornography. The next day, Mateo was granted the warrant by Polk Circuit Court Judge Mary Catherine Green. Mateo returned to Kelly's home and wrote in a report that he examined one of the video cameras and scanned the images, finding several pictures of two women performing sex acts and other photos of Kelly in a sex act. Toward said the affidavit Mateo submitted wasn't adequate because it was based on unspecified information from Chicago authorities and no link was established between the discovery of marijuana and the presence of cameras and child pornography. Thulberry later defended the detective's actions in seeking the warrant. ``I don't think the sheriff's office could have done anything differently in the case,'' he said. Kelly's hits include ``I Believe I Can Fly,'' ``Bump 'n' Grind,'' ``Feelin' on Yo Booty'' and ``Your Body's Callin."

But that changed the night 4-year-old Catherine spotted a porno movie flickering on a screen in a minivan nearby. "Just like there's no windows in a strip club, you shouldn't be able to see inside windows in a car when they're watching X-rated movies," said Carlton, a 26-year-old from Gurnee, Illinois. More and more Americans are buying vehicles with DVD players, usually to keep the kids entertained. But an increasing number of other people on the road are catching a glimpse through the windows of more than just "Finding Nemo" and "SpongeBob SquarePants." Depending on where they are driving or parked, motorists could face fines and even jail time for screening X-rated stuff. But where the law may not be clear, some are calling for tighter regulation. "Residents should not be subjected to those obscenities," said Flint City Councilwoman Carolyn Sims, who is examining whether an ordinance packing a $500 fine is needed. "They do have a right to have peace and tranquility and not to have this exposure to sex in their face." A driver in Schenectady, New York, was arrested last month after rolling past police with a DVD titled "Chocolate Foam" playing on the passenger-side sun visor in his Mercedes-Benz, authorities said. The movie also was rolling on screens set into the car's headrests. The driver was accused of breaking state laws prohibiting watching TV while driving, as well as another law making it illegal to exhibit sexually explicit material in a public place. "The detective had a clear view of what was playing through the window. Anyone walking by on the street could have seen it," Schenectady police Lt. Peter Frisoni Jr. said of the nighttime traffic stop. "If he had dark, tinted windows where you couldn't see in, that wouldn't be a public display." As for Carlton, she was driving in the Chicago suburb of Buffalo Grove with her daughter when Catherine glimpsed the sexually explicit movie. The experience last fall upset the girl and angered Carlton. Carlton and her husband sat down with Catherine and offered the best explanation they could. Since then, Carlton has spotted other motorists with explicit movies playing, including a couple watching from the back seat of their car in a store parking lot. "You're not allowed to have sex in your car, so why are you allowed to watch it?" Carlton asked. Most states, including Michigan, have laws that make it illegal to watch TV while driving. Laws governing the exhibition of pornography vary by state, but experts say they could be applied to drivers as well. "I think those restrictions would apply if the content is located in a vehicle," said Jeff Matsuura, director of the law and technology program at the University of Dayton. "You have effectively moved beyond the privacy of your own home." During the day, it is often difficult to see what is playing inside another vehicle. But at night, the screens are easily visible from a passing car or a vehicle stopped alongside at a traffic light. The screens are also getting bigger. In Flint, Sims took up the issue after hearing from a woman who was driving with her 5-year-old when she spotted porn playing on a vehicle's 13-inch TV screen. A police officer who happened to see the display pulled over the driver, Sims said, but let him off with a warning. To Sims, a 23-year police veteran who retired in 2001, playing an explicit movie in view of other motorists or pedestrians is akin to flashing or having sex in a public place. But Michigan State Police, who have not had any cases of in-car porn, say playing an X-rated movie might not be easy to prosecute unless it can be proved that the motorist intended for others to see it.

Mike Werb and Michael Colleary (Face/Off) will be doing the screenplay. The book and the film both told the story of a special cemetary where for generations, people come to bury dead pets in order to resurrect them. As they come back in their second life, however, they act in a very aggressive and violent manner. (AP) - A videotape of an underage girl exposing her breasts is not child pornography, a judge decided Tuesday in a criminal case against the producer of the ``Girls Gone Wild'' video series. Joe Francis, 30, and several of his employees were arrested at Panama City Beach while filming during spring break last April. Bay County sheriff's deputies charged Francis with racketeering related to prostitution and other crimes, based largely on videotapes of girls under 18. Many of the 43 counts he faces hinge on what conduct is considered illegal or pornographic. ``This ruling shows that the entire fabric of that claim is wrong,'' said defense lawyer Aaron Dyer of Los Angeles. Dyer said he expected the ruling to undermine at least 90 percent of the case. Circuit Judge Michael C. Overstreet made his decision in ordering that defense lawyers be allowed to copy tape confiscated during a search of Francis' rented condominium last spring. Prosecutors had tried to prevent the copying on grounds the videotape showing a girl ``flashing'' her breasts was illegal child pornography. Florida's child pornography law makes the depiction of ``sexual conduct'' illegal and defines that term to include physical contact. There was no physical contact in the video. State Attorney Jim Appleman did not immediately return a call seeking comment. Prosecutors contend Francis and his video crew enticed girls they knew were underage to expose themselves. The defendants deny the allegation and say the girls had lied about their ages. Francis owns Mantra Entertainment Inc. of Santa Monica, Calif., which produces and distributes the videos.

Three adult women and two teenage girls have been charged in the beating of Nicole Townes, who remained in a coma Wednesday more than a week after the attack at a Feb. 28 party. ``I have seen people beaten to death, but not a child and not for no apparent reason,'' Detective Donny Moses said. ``This is a hideous story.'' The attack happened after an unidentified boy, also 12, was dared to kiss Nicole. After the kiss, his 14-year-old girlfriend attacked Nicole, and others joined in, beating the girl for at least 30 minutes. Monique Baldwin, 36, and Erin Baldwin, 19, were charged with attempted murder and assault, said Moses, who said he didn't know the relationship between the two. Kenya Keene, 25, was charged with assault and conspiracy to commit child abuse. Two unidentified teens, ages 13 and 14, were also arrested, but Moses said he did not know the specific charges against them. The adults are also accused of giving false statements about what happened, telling authorities Townes fell and hit her head on a wall.

Diddy, DMX and others in South Florida to protect them, but celebrities and critics see the surveillance as unnecessary and racist. Officers in Miami and Miami Beach have photographed rappers and their entourages at Miami International Airport and staked out hotels, video shoots and nightclubs while consulting 6-inch-thick dossiers of rappers and associates with arrest records in New York state, The Miami Herald reported. ``We have to keep an eye on these rivalries,'' said Assistant Miami Beach Police Chief Charles Press. ``The last thing we need in this city is violence.'' Some experts believe the sweeping surveillance of a genre of musicians is unprecedented. ``There's been no shortage of rock stars and other musicians'' scrutinized by police, said Anthony DeCurtis, contributing editor at Rolling Stone magazine. ``But there has never been anything like this.'' Miami Beach and Miami police did not immediately respond to calls Wednesday for additional comment. Police began gathering intelligence on rap artists after the Memorial Day 2001 weekend, when 250,000 hip-hop fans flocked to South Beach for four days of parties hosted by their favorite rappers. More than 210 people were arrested, double usual number, most for disorderly conduct and intoxication. Although no major rap artists were arrested, police decided to learn the nuances of hip-hop culture, Press said. ``Nobody on the beach had a handle on who the players were,'' Press said. ``We didn't know anything. We didn't know who were the big record labels, who were the kingpins. We didn't know why there were rivalries with Ja Rule and Eminem.'' Officers were sent to New York for a three-day training session in May, along with police from Los Angeles, Atlanta and other cities. That's where they received the dossiers, said Miami police Sgt. Rafael Tapanes. ``This kind of conduct shows insensitivity to constitutional limitations,'' said Nova Southeastern University law professor and constitutional law expert Bruce Rogow. He represented 2 Live Crew when the rap group was prosecuted for obscenity in the early '90s. ``It also implicates racial stereotyping.'' Only one of 97 officers in supervisory positions at the Miami Beach police department is black. Miami has 226 ranking officers and 26 are black. ``The cities should take taxpayer dollars and put them toward something else,'' said Luther Campbell, the former 2 Live Crew rapper.
