LOS ANGELES, California (AP) -- The makers of the Slip 'N Slide filed a lawsuit Monday over a scene in the hit movie "Dickie Roberts: Former Child Star" that shows actor David Spade skidding to a painful halt on the summertime water toy. Wham-O is asking a judge to order the film out of theaters as long as it contains the Slip 'N Slide scene, or for a disclaimer to be added urging viewers not to try the maneuver made by Spade. In the movie, Spade jumps belly first on the yellow plastic sheet without first inflating it with air and water. He then coats the slide with oil and crashes into a fence. The scene has been used heavily in television and theater ads to promote the film, which was No. 1 at the weekend box office. The lawsuit, filed against Paramount Pictures and Happy Madison Productions, charges the filmmakers violated its trademark by using the product without permission. Wham-O also claims the scene violates the product's safety guidelines, which limit the use of Slip 'N Slide to children between the ages of 5 and 12 weighing less than 110 pounds and under 5 feet tall. Guidelines also state the slide must first be inflated and wet and that users should also be wet before diving on the plastic. The company is concerned that the scene might prompt adults to imitate Spade's action, which could lead to injury and lawsuits. "Paramount believes the claims are entirely without legal merit," said studio spokesman Rob Friedman. Representatives of Happy Madison did not immediately return calls Monday seeking comment. The product was taken off store shelves in the 1990s after a series of adult accidents. Wham-O became a privately owned company in 1997 after being put on the market by its former owner, Mattel. When the product was reintroduced in 1997, the new owners added an inflatable bumper and other safety features, Wham-O said. Monday's lawsuit mentions one legal action brought by a Wisconsin adult who became paralyzed after diving onto the slide while intoxicated. The plaintiff in that case was awarded $12.3 million in damages, according to Monday's lawsuit. Wham-O, based in Emeryville, California, also makes the Frisbee, Hula Hoop and Super Ball.

After a 4 OT game against Iowa (I was Penn State) I ended up with a 875 total. God it was back and forth. OT #1: Picked him off in endzone. Got to the goal line and my FB fumbles and they recover. OT #2: FG's for both OT #3: Play Action TD to my WR but miss the mandatory 2 pt conversion. Iowa just runs it up my ass and gets a TD as well but fails the 2pt as well. OT #4: 4th and 3 on the 15 so I have to go for the 1st down. FB gains on 2 yds but by the grace of god I get a face mask called against Iowa. I manage to get a TD with a swing pass to the HB. Got the 2pt on this drive. Iowa's drive was ALMOST successful as they went from the 11 on 4th and 15 after a sack. QB option up the middle and I literally get him just INCHES from a 1st down. I needed a beer after that one. Game lasted over an hour and a half total of back and forth.

Marcus Williams suggested Tuesday that because he's not a big-time player, he "may be blackballed" from the league by the Oakland Raiders and the NFL if he pursues legal action against the team and linebacker Bill Romanowski. "I haven't ruled out legal action ... right now," Williams said on The Dan Patrick Show on ESPN Radio. "I don't know yet." Romanowski and Williams were involved in a training camp fight last month during which Romanowski ripped off Williams' helmet and punched the reserve tight end in the face, breaking his left orbital bone and chipping his tooth. "It was a drill and we got into it," Williams explained. "[Romanowski] yells ... 'don't push me' ... then I feel my helmet come off, then I got hit right after." A day later, the Raiders placed Williams on injured reserve, ending his season. Williams, a second-year pro who played mostly on special teams last season, was taken to a local hospital for a series of tests following the incident. He saw an eye specialist the following week and was told to rest at home for a week to alleviate the swelling. But two weeks since the incident, Williams said he still has double vision. "I'm still seeing double. When I turn my head and look around, I get a bit dizzy. Headaches, too," Williams said Tuesday. Neither Kolligan nor the Raiders organization have responded yet to Williams' latest statements. Williams' agent Lee Kolligan, who appeared on The Dan Patrick Show on Aug. 26, said that the Raiders had contacted him to suggest that the matter should be handled in-house, but Kolligan also said that if Williams' career was determined to be in jeopardy, pressing charges against Romanowski and possibly the Raiders is something Williams would have to think about. Williams is scheduled to make a base salary of $300,000 this year while on injured reserve, but his placement there means his season is over. "Is there any excuse for potentially ending a player's football career?" Kolligan told The Associated Press last month. "We'd rather not (sue), but if it comes down that this man has lost his football career as a result of this incident, then I would hope we can get some compensation." Romanowski apologized to Williams within days of the incident. "I hold myself accountable," Romanowski told AP. "It was a classless move by me." "I made my apologies. I said what I had to say to him. I pretty much told everybody what I had to say. You can try to make excuses, but there's no excuses. It just won't happen again." Romanowski was suspended from one practice and fined an undisclosed amount by the team. Romanowski also apologized to the rest of the team prior to his return to practice. Afterward, some Raiders players seemed almost indifferent toward the matter. "Everybody knew what they were getting when he [Romanowski] came here," guard Frank Middleton said. "As long as it doesn't happen again, it'll be fine." Romanowski has had a history of on-field altercations during his 16-year NFL career -- most notably for spitting on 49ers receiver J.J. Stokes. He has been fined several times by the league. He signed with Oakland before last season, and he finished second on the team in tackles while helping the Raiders to their first Super Bowl appearance since 1983. His influence on Oakland's defense has been praised, and he hadn't been in any trouble with the Raiders until the Williams' incident. Information from The Associated Press was used in this report.

It would refer to any filesharing software that you are downloading copyrighted material from IF you are downloading copyrighted material. Me and you could swap sound files of each other farting all we want and wouldn't get in trouble but if we swap St. Anger by Metallica then you can be sued.
