"NY Man Sues, Claiming Fast Food Ruined His Health Fri Jul 26, 5:43 PM ET By Gunna Dickson NEW YORK (Reuters) - A 5-foot-10-inch, 272-pound man has sued four major fast food chains, claiming their fare contributed to his obesity, heart disease and diabetes, his attorney said on Friday. The class-action lawsuit, filed in the Bronx Supreme Court on July 24, is seeking undetermined compensatory damages against McDonald's, Wendy's, Kentucky Fried Chicken and Burger King on behalf of 56-year-old maintenance worker Caesar Barber and others. The lawsuit, which estimates that millions of Americans could be included in the claim, also seeks to have the companies label individual products with fat, salt, cholesterol and other dietary content as well as to warn users of the health effects. New York attorney Samuel Hirsch, who is representing Barber, said consumers are not getting adequate warning about foods that could cause obesity, diabetes, heart disease, high blood pressure and elevated cholesterol levels. "Fast food chains failed to disclose the contents in terms of calories, fat grams and sodium. Even when posted, the information is not easily understandable to the public," said Hirsch. A National Restaurant Association executive said the lawsuit "gives frivolous a bad name." "This lawsuit, which solely makes restaurants responsible for obesity in America, swallows a simplistic notion," said Steven Anderson, president and CEO of the Washington-based association. "It is a blatant attempt to capitalize on the recent news stories on the growing rates of obesity." LABELS FOR ROCKET SCIENTISTS? Barber told MSNBC he didn't realize fried food was bad for him until three years ago, and that he had been eating fast food for decades because it was convenient. "I didn't find out how bad it was until 1999," he said. "I ate a lot because I was by myself." Hirsch, who accompanied his client on the MSNBC show, said they particularly wanted better labeling for the "real offenders--the Big Macs and Big Whoppers." Now, he said "you have to be a rocket scientist" to be able to read labels that he said were deliberately designed to be confusing. McDonald's spokesman Walt Riker called the claims "ridiculous," saying: "Our menu features choice and variety with lots of options for consumers." In Miami, a spokesman for Burger King, which was bought by Texas Pacific group on Thursday, declined to comment as the matter is under litigation, but referred calls to the National Restaurant Association. "There are 858,000 restaurants and food service outlets in the country serving a variety of food that will meet anyone's specific dietary needs," said the association's Anderson. "The nutritional information usually appears on a chart at the right of the counter and is as easily understood as any nutrition label you would see at the retail store." "The important thing to remember is that there is a certain amount of personal responsibility we all have... the issues of obesity and nutrition are much more complicated than this and involves factors such as genetics, medical conditions and the level of physical activity," Anderson added." ...call me crazy, but never before have I wanted to just kick somone right in their testicles because of their decisions, more so than right now. Every case, no matter how frivolous or how legitimate, must be taken equally. Allowing common sense into the equation would stop a lawsuit like this at the grass roots level, before it even came close to a courtroom. But a lawsuit like this is put on the same level as one where there actually is another party at fault. An attorney will always take the case, number one because he can, the system as it is allows for such things, number two because it can set him for life. Obviously, he's going to lose, it's an open and shut case without a shadow of a doubt... but, if he wins, we all win. I'd be willing to bet that each and every one of us has had a McDonalds at some point in our lives. I'd also be willing to bet, since we're members of the internet wrestling community, that none of us are entirely skinny. Basically, if he wins his case it sets a precedent for everyone in the world who has eaten fast food and has any fat on them at all. That he didn't know it was unhealthy for him until 1999, and the lack of warning on the part of the fast food companies are the important parts of the equation that would allow it to even get to trial and explore issues such as failure to warn, design defect, etc. To join the class action, you'd probably have to show a similar lack of knowledge. Also depending on the type of class action filed, future suits may be barred by res judicata -- meaning you have to join this guy's suit if you want any money. They had been warned before by the FDA that their coffee's temperature was too high, and the burns on the woman's legs were severe. I mean way more severe than you would expect from a cup of coffee. McDonald's had plenty of opportunity to settle it, but like everyone else they didn't take the lawsuit seriously, and they ended up paying for it. I don't feel bad about that one at all. McDonald's had (and probably still has ) a policy where they keep their coffee hotter in the vain hope it will taste fresher longer. It's above what is defined by the FDA as the safe norm, and they'd been advised before to change this policy. 2. The woman only sued for her medical expenses, which is quite reasonable. It was THE JURY who decided to award her $4 million in damages. That was reduced on appeal, but it's not the lady's fault she ended up winning such a ridiculous sum. Right, and that's a big problem when cases like this come up. It's one thing if he got deathly ill because he ate contaminated food. It's quite another to eat like a pig and then blame the restaurant for taking your money all those times. Type 2 Diabetes makes you do somethings you never thought possible like : STOP EATING Fat endusing greasy freaking foods. i probably had a fast food lunch everyday for the past 12years, never thought any thing of it. Considering i weighed 240lbs when i left highschool, playing left guard on the football team i was actually 79% muscle mass. That easily all turned to fat and i just kept gaining weight. I know its my own damn fault, i blame nobody but myself, not McDonalds, Wendy's, Burger King, Taco Bell, Jack in the Box, Hardess, Miami Subs or any other fast food restaraunt that i have been to in the past. Get the steel tipped shoes on take a 10 yard running start and just kick that fuck right in the "jimmie" . Stupid ass shouldn't even be allowed to live and neither should his lawyer.
