Ok, while outside the Kingdom( a rock club near Toronto) last night i was charged $130 for having an open beer can with me in the back of my friends car. Granted, it was foolish of me and yes i do deserve the ticket, ALTHOUGH, the can was empty when i handed it to the cop so i could argue that i didn't drink from the can and it was there from before. So thats what i;ll say when i take it to court.......that could work right.........right?

 

Weasling out of out of us is what seperates us from the animals.......except the weasels.

Open container is open container no matter how you look at it. Can't hurt trying though

I got an open container violation just before a Radiohead concert in the summer of 2001 at the Blossom Music Center in Cuyahoga Falls, Ohio. Damn near ruined the concert.

 

I really don't know the law concerning having an empty beer-can in your car in Canada though. So can't help you with that.

If you got the money, you may consider getting yourself a lawyer. Or you could just talk to one pro bono, see what he says you should do.

Law isn't exactly my expertise but if you argue that the can was there from before just cause it was empty, couldn't the prosecution just argue that you drank it, thus it was empty?

Since it's before a judge and not a jury, the prosecution would more or less have to prove that he had drank it. It's only a $130 ticket though. It's the equivalent of getting a speeding ticket.
