If anyone bought from soundgarden92 on half.com...

This guy, soundgarden92, was selling bootleg WWF PPVs on half.com.  Normally, buying bootlegs wouldn't bother me, but this idiot was listing them as if they were Coliseum Video originals, and some people got screwed on the deal.  (What's even worse is that these were HORRIBLY OVERPRICED for bootlegs, at that.  The lowest one was $10, and I believe that some ended up in the $20+ range)

 

I, personally, didn't get screwed because I used the "Ask the seller a question" function to ask him about the tapes' legitimacy and HE ADMITTED that they were phonies, although that tape "mysteriously" disappeared from the listings shortly thereafter, along with the public record of the questions and answers.  What makes this MORE fun is that I forwarded the whole thing to half.com so that they could look into the rest of his inventory and NOTHING HAPPENED.  

 

Now that some people have gotten screwed, I think that they are in a VERY precarious position for a negligence lawsuit as they were informed about this seller yet did NOTHING.

 

If anyone here actually bought from this guy, drop me an e-mail at [mail][email protected][/mail] so I can send you copies of my correspondance with this moron, which could be used in case of a lawsuit or to expedite a refund from half.com.

 

(I MAY be blowing this out of proportion with talk of possible lawsuits, but I think that half.com's inaction would prove to be an interesting court case if they refuse to refund the money of the buyers)

Considering you don't have any proof that he actually sold bootlegs (he could've been lying to you.. hey, there are weirdos out there) this wouldn't even see court time. Also, for bootlegs, $10 or so is actually a decent price.

 

You really can only sue someone if they caused you some sort of damage or loss, and he did neither, so there's no grounds for a lawsuit of which would cost you more money to attempt to go through with than what you would receive in the end.

 

The guy may be a piece of shit, but if Half.com wouldn't do anything, hey, your only option is not to buy from him yourself, and warn other people on his auctions.

The problem is that it's blatant misrepresentation and a violation of Half.com's own listing policies to list counterfeit items to begin with, then there's the hassle of trying to get a refund from them which is supposed to be a pain in the ass if the seller is uncooperative, as well as the costs of packaging and mailing the tape back to the seller.  

 

 

Besides that, I've bought ORIGINAL WWF tapes online for less than what he was selling bootlegs for, which is why this moron pissed me off so bad.  In fact, he's listing his bootlegs for a few cents less than sellers with original tapes in some cases.  And I'm not just blowing smoke about this guy selling bootlegs, as there is at least one person who's given him a 1 of 5 so far over this, and I predict that most of the other 15 people who bought from him will do the same.

 

 

Like I said before, the term "lawsuit" is probably not appropriate for such a small amount of money being involved, but it would be a necessary threat to Half.com if they are hostile to any attempts to refund money to the people this guy has ripped off.  

 

On sites like BizRate, there are plenty of horror stories that buyers have of Half.com refusing to refund money no matter what the problem may be (including merchandise never being received or getting something that is COMPLETELY different from what is listed) if the seller is uncooperative and (typically) has decent ratings from their other customers.  The only plus in this case is that this seller was unrated before he sold all these tapes, which means that Half.com is much less likely to stand behind him with few or no questions asked.

I believe you'd take him to small claims court if you were to present the case. I'm not sure of the minimum amount of damages  that have to be inflicted to do so, though. Like, you won't get an ear from any court over a case worth $20 in used wrestling tapes. If you could somehow find that this guy has ripped people off of hundreds of dollars, then you _may_ (and that's a big may) have something. I'm not trying to be an ass in saying this or anything, but it'd be #### difficult to prove anything like this, especially considering the damages aren't really worth much.

 

Best thing to do: report him to WWFE for selling bootlegs of their tapes. :)
