Guest JaKyL25 Report post Posted July 19, 2003 I have no actual technical knowledge, but I would assume that what would separate Assault & Battery from Attempted Murder would be the amount of force involved. Was there enough to say that the assaulter could have killed the person if they were allowed to continue? If not, then I don't see how it's attempted murder. And yeah, you're probably not going to be charged anyway. edit: oh yeah, in my case, they gave me some anger management classes, so there's that too. I forgot because I skipped them. Just be sure you bash whoever you're planning on bashing with only your fists. As soon as you pick up something to thump him with, that can be construed as assault with a deadly weapon.. Guest DrTom Report post Posted July 19, 2003 If you swing and miss, it's assault. If you swing and connect, it's assault and battery. If you swing and connect with a weapon like a baseball bat, the charges become more severe. Also, if you swing and connect with your fists an awful lot, it's quite possible to beat someone near (and to) the point of death, so there's that to consider.
