Marc Emery cuts deal with US authorities, prison for ten years

Marijuana activist and promoter Marc Emery may be heading to jail soon, after his lawyers cut a 10-year deal with U.S. prosecutors.

 

In July 2005, U.S. drug enforcement officials asked that Emery be extradited so he could face charges that he, Greg Williams and Michelle Rainey distributed millions of cannabis seeds to American customers at an annual profit of $3 million.

 

He has since been free on bail while fighting extradition. Emery said his lawyers told him there was no hope to refute the U.S. allegations, and the Americans were demanding he serve a 10-year prison term, with at least five years in custody, most of it in Canada.

 

If the federal government accepts the proposal, Emery said he could be behind bars in the U.S. within 60 days, but he also said the deal means no jail time for his co-accused, Williams and Rainey.

 

The so-called prince of pot has run several times for public office as leader of the Marijuana Party, and has fought several court battles to change Canadian cannabis laws.

 

Absolutely tragic. The guy has done nothing wrong and can be extradited to the US on a technicality, and the Canadian government isn't sticking up for him at all.

I think weed should be legalized, but until that happens, don't whine about being arrested and punished for something you already knew was against the law.

Problem is that you can only extradite someone if the offense is a crime in both countries. Selling seeds is technically illegal here, but that law hasn't been enforced in decades - that amounts to de facto legalization. In the US he could have faced 25 years or more in an American pound-me-in-the-ass prison. The whole thing is so ridiculous, Canadian government could simply refuse to cooperate with the American authorities, but everyone wants to lock Emery up for whatever they can get him for - he's a "pot crusader" who flouts the law with respect to pot in whatever way he can and believes the best single way to "fight for marijuana" is to increase the amount of marijuana in the world, thus the selling seeds. The RCMP must be thrilled.

 

He's also the publisher of Cannabis Culture, the founder and current leader of the BC Marijuana Party (that got 3% of the votes in the 2001 election!), and a libertarian.

What? No, flat wrong. There's all kinds of shit which is illegal in America but not elsewhere, yet which the government is still more than willing to go after people for.

I agree that it's obviously a political move, by those in both governments who don't take kindly to the legalization movement. But still, he did break the law, and he knew it when he did it. There's no way a crusader like that hasn't memorized every cannabis-related law on the books.
