The Dems may be falling into a no-win situation, actually. If they have 41 votes or greater against Alito, many people on the left will demand they filibuster, then Frist will respond with the nuke. They may wish to save the filibuster for a next time (it can only work if they have the popular support of the American people, I believe). But honestly, if there really were extraordinary circumstances to filibuster Alito or some other nominee, it wouldn't be necessary because that person wouldn't be able to get majority support on the floor.

Obama voted against John Roberts, and if a Dem couldn't support him, I doubt a Dem could support any Republican SC nom.

I doubt many voters get excited about moderate politics. I've heard the media refer to Lincoln Chafee as a moderate, when he really has quite a liberal voting record. I don't know what to make of the tag, actually. Can a moderate be pro-life or is a moderate always pro-choice? Are moderates expected to support McCain's campaign finance reform? Does a moderate just split the difference on a particular policy matter? Seems like a meaningless term, at least to me.

In the lead up to the hearings, I got the impression that this would be the battle to end all battles, an impassioned debate over the role of the Supreme Court. That never happened. The Dems big mistake is they tried to produce a gotcha moment. It seemed to be their only strategy. The highlight was Kennedy and Spector arguing over mail sent/received. The entire thing became comical.

I've watched quite a bit of the hearings. Yesterday, the Democrats hit rock bottom. It was embarrassing to watch them implode. I was impressed with the way Specter brought the smack down on Ted Kennedy.

You know, there was a 13-0 Auburn team got shut out of the BcS. They didn't even get to "share" the championship like USC did. So yeah, shut up Matt Leinart.
