Details On Lawsuit Filed By WWE Against PWS

For those who are unaware, a lawsuit filed by WWE was placed on ProWrestlingSCOOPS.com earlier today. The lawsuit stated that 'WWE is the owner of numerous trademarks and copyrighted works. WWE alone has the exclusive right to exploit its copyrighted works, and, as the premiere provider of wrestling entertainment services, WWE has established substantial and valuable goodwill in its trademarks.'

 

In the lawsuit, they stated that "You have registered and used the Internet domain name PROWRESTLINGSCOOPS.COM, which

contains WWE's mark. Your use of this mark violates WWE's trademark rights and is likely a breach of your domain name registration agreement. As such, we demand that you immediately stop using this for any purposes whatsoever. Your site also infringes upon numerous copyrighted works owned by WWE."

 

It went on to say that PWS was to do/not do the following:

 

1 Do not provide play-by-play reports or other infringing materials, whether live, delayed or after the fact.

 

2 Remove WWE's copyrighted works (including images, audio, video, text etc.) from your website and do not post or link directly to such material in the future.

 

3 Stop using WWE's logos.

 

4 Regarding VENGEANCE, we demand that you will not provide the above-described coverage of it, either during the event or after the fact.

 

WWE has asked us to shutdown ProWrestlingSCOOPS.com in an effort to 'control' internet websites.

 

Now for a response from the PWS staff: First and foremost, we do not see where ProWrestlingScoops.com violates a WWE trademark. There is no mention of WWE in the title of the domain, therefore, that claim is false. We also do NOT use copywrited WWE images on this website. All of our images are made by us using Adobe Photoshop. Also, it is NOT illegal to type text of an event as it's ongoing and post it to the public (Play by Play coverage). This lawsuit has been brought against PWS, in what we feel, is an attempt to try and get rid of one of the bigger pro wrestling websites on the internet today. It's really a shame that WWE has, and is going to all extremes to protect their product from the internet (Of all places). We at PWS post backstage news and rumors on a daily basis. We are trying to promote WWE's product to further their success. Although some of the things we report about the company can be negative at times, that's the way it works when a companies product is not appealing to the general public. We are all fans of the product, but those of us who surf the internet get a more in-depth look at the company. Let's face facts WWE, if your running a multi million dollar company, inside news is going to get out whether you like it or not. Where will that inside news be posted? Right here on ProWrestlingSCOOPS.com because the fact of the matter is this - We are not going anywhere and will remain one of the premier pro wrestling websites on the internet. If this matter goes into a court of law, we will pursue the proper legal action as well as lawyers/attorneys if need be. PWS will be here for a long time to come. Before we end this, we ask WWE one final question - Why not spend money on hiring a decent group of writers to write your product instead of hiring lawyers to sue websites who report the real facts that WWE doesn't want you to see?

WWE got more important shit to worry about...like the fact their product is shitty, but they still take the time to SQUASH a dinky little webpage kinda like last year when they systematically crushed every fan's webpage for having pictures of their wrestlers on it.

So wait a second. They provide the play-by-play for the people who can't watch the show (those who don't have UPN or forget to set their VCR) and they're trying to stop THAT too?

Why didn't WWE send one of these to wrestlingobserver, pwtorch, or 1wrestling? They all post pbp of ppvs and shows. This is ridiculous and sounds like a bs letter someone just sent them and suckered him into posting it.

But WWE has no case--costs of legal fees could force these guys to comply though. There's not even a good reason for this, it's just bullying.

I understand that and if this is legit it they should follow through on it. I was just wondering if the site was worthwhile for any reason and if we would be missing out on anything if they were taken down.

Why would they go ahead and "file a lawsuit" when all the letter contains is a cease-and-desist letter? Wouldn't they threaten to file a lawsuit afterwards if they didn't agree to the c&d?

I vote for fake also. I highly doubt WWE would go after such a shit site while keeping the "big boys alive"

 

A lot more people go to the big three than any of these other sites.

 

This is just some moron sending them something to fuck with them, more than likely some sort of their competition. If not than, then simply some disgruntled ex-staff guy or a banned member.

It could be a fake, but this isn't the first time WWE's tried stuff like this. Remember, you can't put have a tape trading site with WWF/E or WCW footage on it these days unless you prove that all you're using are commercial releases.
