Guest MikeSC Report post Posted October 9, 2003 Because, if he wasn't thinking, if it was done on the spur of the moment and wasn't pre-meditated and simply escelated from there one could argue that second degree murder is more appropriate. Is it possible to get murder one without premeditation? Or is murder one decided upon the nature of the crime and/or its intent? I think they can pull a premeditation when he stepped over his body and went for the kill shot like he did. And B-X, where the hell is your response to all this? Good point.
