(AP) -- A female athletic trainer can sue Indianapolis Colt quarterback Peyton Manning, his father and a writer for defamation in a case stemming from a 1996 incident where Manning dropped his pants in her presence, a judge has ruled. Circuit Court Judge Harvey A. Kornstein refused Monday to throw out the lawsuit against Manning, his father, former New Orleans Saints quarterback Archie Manning, writer John Underwood and publisher HarperCollins Inc., saying there is enough evidence for a jury to hear the case. The lawsuit was filed by former University of Tennessee trainer Jamie Ann Naughright in May 2002, who says she was fired as an assistant professor at Florida Southern College in Lakeland after the book, Manning: A Father, His Sons and a Football Legacy disparaged her. The book gives Peyton Manning's version of a 1996 incident in which he dropped his pants as Naughright examined one of his feet in the Volunteers' locker room. Naughright alleges that placed his testicles and "naked BUTT and rectum" on her face. Without using Naughright's name, Manning's book says the trainer had a "vulgar mouth," but concedes that his behavior was "inappropriate." "Crude, maybe, but harmless," he wrote. Kornstein wrote there is enough evidence to suggest that the Mannings, the writer and the publisher knew the book passages in question were false and acted in reckless disregard for the truth. He also rejected the argument that the statements are not defamatory and that Naughright is a public figure who has to meet a higher standard to bring such a lawsuit. But the judge ruled that Naughright remains a private citizen despite the publicity her complaint against the University of Tennessee garnered and the one unsolicited award she received from the Knoxville Chapter of the National Organization for Women. A trial is set for March. Robert Puterbaugh, the Lakeland attorney who represents Naughright, declined to comment Tuesday on the ruling. The attorney representing the Mannings and the other defendants did not immediately return a call for comment. Wow, first Kobe, now Peyton... how long until every supposed "good guy" in sports becomes the subject of lawsuits (criminal or civil)... I can almost see someone filing a paternity suit against David Robinson at this rate. And also, I'm not exactly sure how accusing someone of having a potty-mouth constitutes defamation of character...
