Nichols Escapes Death Penalty

Now, I've already made it clear I'm opposed to the death penalty from a fundamental viewpoint, but as long as it is on the books, I can't see any line of reasoning that would allow Terry Nichols to escape from it. He's already received life without parole from a separate trial, so there's no worry of him ever getting out, but this still seems very strange. It's not like the case was circumstancial or something.

Death penalty. We shouldn't let off a terrorist just because he happens to be "our" terrorist.
