Can someone explain the process of

Recommended Posts

Well since there was a big broo-ha-ha over Bush appointing enough pro-life judges to tip the scales in that favor, I am just curious what is the process of Roe v. Wade being overturned(and for the record, NO I don' think it is going to happen or anything I am just curious) Does a lawyer or prosecuter have to reintroduce the case and then they go back through the entire trial all over again, kind of like the way appeal cases work, or is it just a matter of getting the judges appointed and then they sort of just collectively say..."umm, we are overturning our decision as a collective body" ???

As far as I know, its the former. The Supreme Court's only job is the last court of recourse in the US, i.e. the last place you can appeal to.

Actually, it's a decision on a completely different case than the one originally heard. So no matter what, you wouldn't see Roe v. Wade overturned within a year of the new judges being promoted to the bench. These things take time, you know.
