KNOXVILLE, Tenn. - The creators of the video game series "Grand Theft Auto" want a federal judge to dismiss a $246 million lawsuit filed by the families of two people shot by teenagers.

 

Rockstar Games and its New York City-based parent, Take-Two Interactive Software, said the victims' families were trying to hold them liable "based on the expressive content of the video game."

 

 

Retailer Wal-Mart and marketer Sony Computer Entertainment America Inc., are also named in the lawsuit.

 

 

Aaron Hamel, 45, was killed and Kimberly Bede, 19, was seriously wounded when their cars were hit June 25 by .22-caliber bullets while driving along Interstate 40.

 

 

Stepbrothers William Buckner, 16, and Joshua Buckner, 14, were sentenced in August to an indefinite term after pleading guilty in juvenile court to reckless homicide, endangerment and assault.

 

 

The boys told investigators they got the rifles from a locked room in their home and decided to randomly shoot at tractor-trailer rigs, just like in the video game "Grand Theft Auto III."

 

 

Responding Oct. 29 in U.S. District Court, Rockstar and Take-Two contend that such ideas and concepts as well as the "purported psychological effects" on the Buckners are protected by the First Amendment's free-speech clause.

 

 

A lawyer who represents the victims dismissed the claim, saying he would seek to move the case back into state court for consideration under Tennessee's consumer protection act.

That better be dissmissed, I mean seriously; they've either got serious pychological problems, or are trying to get out of it. I mean, how can it be the games fault their nutz? They weren't 100% rational people, then played the game and suddenly "I KNOW, let's go and KILL PEOPLE! YEAH! Wooo!"

 

I mean, if I speed, say "Race Driver" or "GT3" made me do it . . . would they then sue them? If I beat the living shit out of someone, and say Tekken 4 made me do it, would they then sue Namco? It's shit, that's what that is. People money-grubbing anyway they can. Disgusting the depths people will sink to, using a tragedy and cause of great sorrow to make themselves rich.

I thought Wal-Mart didn't even carry M-rated games?

 

Anyway, throw the little bastards in jail for life and make 'em do hard labor till they die. Give them a large, hairy, burly cell mate.

Yes, but when I say a lawyer is in it for the money the person is a REAL scumbag.

 

Funny lawyer story. My better half and I rent a duplex from the father (I'll call him Tom) of my better half's best friend.

 

The people that lived here beforehand were Tom's brother and Tom's brother's wife. Tom's brother is a lawyer. Here's a short list of his guy's accomplishments:

 

1) Made his elderly parents sign over all their "rights" and assets to him and were placed in a retirement home.

 

2) Didn't pay their garbage bill for the last month. (Guess how I know that one?)

 

3) Moved out three weeks late and didn't give my better half a chance to move some early stuff in.

 

4) Said that they would leave two unit air conditioners in place for us (We offered to buy them off him), and when we moved in during a sweltering August evening, guess what wasn't there? Yep.

 

Gee, and this guy's a lawyer?...

Well, my girlfriend is a lawyer, and she is honestly in it to help people. While that might sound like the stupidest thing ever (as I've pointed out to her), she isn't into personal injury or these scandalous lawsuits - she specialises in conveyancing and dealing with wills and estates and testates and stuff. To put it in her words, "I like helping little old ladies sort out their wills and helping people move into big fruity houses."

 

To be fair though, I can't think of any of her lawyer friends that I've met who are anythign like as morally responsible/naive.

Well, my girlfriend is a lawyer, and she is honestly in it to help people.

I believe you -- stranger stuff has happened.

 

My better half has a Master's in Psych and doesn't go for any of that "My mom was mean to me as a kid" b.s. that many crazy people tend to use for the reason they poop on an office's floor...
