Police find 7-year-old at the wheel after chase

Boy sitting in father’s lap after hit-and-run; dad arrested

Updated: 12:40 a.m. ET Dec. 11, 2005

FLEMINGSBURG, Ky. - Police got a surprise when they stopped a van following a hit-and-run crash on Kentucky’s Mountain Parkway: A 7-year-old boy was at the wheel, sitting on his father’s lap.

Donald Everett Waters, 39, of Flemingsburg, faces two felony counts of wanton endangerment and numerous other charges following the Friday afternoon incident.

When police caught up with the van on Interstate 64, Waters was working the foot pedals and his son Cody was on his lap steering, Clark County Sheriff’s Deputy Ricky Estes said. He described Waters as “semiconscious.”

“He said he was en route to Florida, and his son was going to get him there,” Estes said.

Waters’ 3-year-old son was also in the van, Estes said. He said it appeared Waters had been living out of the vehicle.

The children were taken by social services. Waters, meanwhile, faces several charges, including resisting arrest, carrying a concealed deadly weapon, leaving the scene of an accident and driving under the influence.

Man Who Allegedly Allowed 7-Year-Old To Drive Pleads Not Guilty

Flemingsburg, KY -- A Fleming County man accused of letting his 7-year-old son take the wheel of his van on the Mountain Parkway Friday pleaded not guilty to numerous charges via video arraignment in a Clark County courtroom Monday afternoon.

Donald Everett Waters, 39, of Flemingsburg, faces two felony counts of wanton endangerment and numerous other charges. He is being held in the Clark County Detention Center on $5,000 bail.

Police say one of the charges is DUI, the third such charge against Waters.

Police were called to the scene of a minor accident on Interstate 64 in Winchester about 3:30 p.m. on Friday.

A driver involved in the crash told police it appeared that a young boy was driving the other vehicle, which left the scene.

When police caught up with Waters' 1988 Chevrolet van, he was working the foot pedals.

His son Cody, who was sitting in his lap, was steering, Clark Sheriff's Deputy Ricky Estes said. He described Waters as "semiconscious."

"He said he was en route to Florida, and his son was going to get him there," Estes said.

Waters' 3-year-old son also was in the van. It appeared Waters had been living in the van, Estes said.

Estes said social services has placed the children with family in Winchester.

Waters faces a number of charges, including resisting arrest, carrying a concealed deadly weapon, leaving the scene of an accident and driving under the influence.

When Estes asked whether it was a good idea to have a 7-year-old driving, Waters responded that he was driving farm tractors at age 7.
