It gives employers freedom to hire and fire employees in whatever manner is most effective, and leaves employees free to either agree to it or go work somewhere else. It's bullshit that the employers choose to do that, but from a philosophical standpoint, I can't justify the government stopping them. Two words: affirmative action. Smokers are not a racial or ethnic minority. They're people who choose to maintain a filthy, disgusting habit, and they have to bear the responsibilities that come with that habit. Fat people indulgein the habit of taking McDonald's advice to 'pound' burgers regularly. Unless being fat fucks with their job performance, I don't think they should be fired. Old people, fat people, depressed people, and bad drivers are all at a much higher risk of serious injury/illness or death than the average citizen, but they're not being persecuted here. I still think that employee drug testing shouldn't be legal. Your employer can't search your car or your home, but it's okay for them to suck the blood out of your veins?
