By Steven Kreytak AMERICAN-STATESMAN STAFF Wednesday, February 13, 2008 A federal appeals court has struck down a seldom-enforced Texas law making it a crime to promote or sell sex toys. The 5th U.S. Circuit Court of Appeals, ruling in a case originally filed in federal court in Austin, found that the ban in the Texas penal code on selling or promoting obscene devices violates the right to privacy under the 14th Amendment of the U.S. Constitution. "Whatever one might think or believe about the use of these devices, government interference with their personal and private use violates the Constitution," said the opinion in the case considered by a three-judge panel of the New Orleans-based court... The idiots in the "bus" are the biggest rip-off cause they are complete spazs. This is actually a surprising step coming out of Texas. Did they ever lift that whole "prison for anal sex" thing or is that still alive and well down there? And as bad as Texas is, at least they aren't like some counties with bans on adult films. When I lived in Arlington Heights, my parents, both reliable Republicans, signed a successful petition to keep a gun store from operating across the street from the high school. It was on the other day here. The court did the sensible thing, if it's in the privacy of your own home... whatever.
