LOS ANGELES - Child welfare investigators earlier this year found there was no basis for allegations that Michael Jackson had abused the boy now accusing him of molestation, according to a confidential memo.

 

 

The memo from an administrator with the Los Angeles County Department of Children and Family Services was based on an investigation last February and was leaked to the Web site thesmokinggun.com, which posted it Tuesday. A source familiar with the document confirmed its authenticity to The Associated Press.

 

 

The memo was dated Nov. 26, 2003 — a week after the Santa Barbara County district attorney announced child molestation allegations against Jackson.

 

 

Both the boy and his brother told investigators Jackson had not sexually abused them, according to the memo. Their older sister said she had never witnessed anything sexually inappropriate between her brothers and the entertainer.

 

 

The memo was sent from a regional administrator to bureau chief Charles Sophy and detailed a probe completed before Sophy joined the agency.

 

 

Jackson's defense is certain to seize on the memo.

 

 

Santa Barbara County District Attorney Thomas Sneddon did not immediately return a call for comment Tuesday.

 

 

The memo, which refers to Jackson as "the entertainer," said the department began a 13-day inquiry after a Los Angeles school district official called its hot line Feb. 14 out of concern for the boy and his brother. The investigation was conducted with the Los Angeles police.

 

 

The school official suspected neglect by the boy's mother and sexual abuse by Jackson, according to the memo. But the department and the police concluded the allegations were "unfounded," the document said.

 

 

Louise Grasmehr, a spokeswoman for the child welfare department, said the leak would probably be investigated because the memo was supposed to be confidential under state laws designed to protect children. Police spokeswoman Officer Sandra Escalante had no comment.

 

 

The school official called the hot line after the child, a cancer patient who had visited Jackson at his Neverland Ranch, appeared in a TV documentary in which the boy told an interviewer he had been a guest for sleepovers at Neverland. In the documentary, Jackson defended his habit of letting children sleep in his bed as "sweet" and non-sexual.

 

 

The boy's mother told investigators in February that "she believed the media had taken everything out of context," the memo said. The mother said that the children were never left alone with Jackson and that her son slept in the same room with Jackson but never shared his bed. She said Jackson would sleep on the floor.

 

 

Separately, the mother contacted an attorney around the time the documentary aired, saying she thought her son had been abused.

 

 

Jackson was booked Nov. 20 on suspicion of child molestation. He has denied the allegations and was released on $3 million bail. Authorities said they expect to file formal charges next week.

 

...this can't be looked at any other way than good news for Jackson, I thought some of you might find it interesting.

SANTA BARBARA — The prosecution in the Michael Jackson case may have a new witness to corroborate claims of molestation - the alleged victim's brother.

Court TV anchor Diane Dimond said her sources have revealed that the ailing boy's younger brother is providing information about his family's visits to Jackson's Neverland ranch.

 

Dimond, who also worked on the 1993 Jackson investigation, told ABCNEWS' Good Morning America that she has learned from sources that the alleged victim's younger brother says he "witnessed at least one act of molestation."

 

The 14-year-old accuser was 12 at the time of the alleged crimes, and his younger brother turns 13 next week.

 

Dimond says the boys' older sister, who stayed in a different section of the Neverland compound during family visits, may also be ready to talk.

 

"I'm told that the sister, who is of high school age, I believe she's 18, noticed a change in her brother," she said.

 

Dimond said the sister reportedly asked her brother about a change in his behavior before the charges against Jackson were filed. The sister could testify about what she learned during that conversation, but Dimond reports that the accuser's mother supposedly knew nothing about the boy's allegations during the family visits to Neverland.

 

"I was told one of these children, especially the alleged victim didn't tell his mother," Dimond said. "She had been through a terrible time with her husband … it was so nice to see mom with a smile on her face at Neverland," she said.

 

Jackson was arrested after authorities raided his Neverland ranch last month. Dimond says during their search of Jackson's ranch, investigators actually found at least one of the items the accuser had described.

 

"Any time you have a police investigation like this, they'll sit the child down and say, tell us specific things," Dimond said.

 

"In this case, I'm told they asked, 'did you see any pornography?' or some such question. And the accuser in this case said there was a suitcase full of pornography used to sort of get the mood right, and by gosh, when they went into Neverland, I'm told they found the suitcase in the exact location the child said," Dimond said.

 

Second Child?

New reports from retired Santa Barbara sheriff Jim Thomas say that investigators in the 1993 Jackson case spoke with a second child who claimed to have been molested by the pop star, but no charges were ever filed.

 

The former sheriff says the alleged molestation case, which never went anywhere since the child never testified, would not have resulted in felony charges against Jackson since the allegations were not as high level as the other boy's allegations.

 

Jackson's first accuser eventually ended his cooperation with authorities after his family secured a reported multimillion-dollar civil settlement with the pop singer.

 

Thomas said the second child could not have been used as a corroborating witness even if the primary victim had testified in court back in 1993.

 

What About the Money?

The current alleged victim and Jackson first met when the boy was undergoing medical treatment. Jackson met the alleged victim as a favor when he was told by Jamie Masada, a comedy club owner who runs a camp for underprivileged children, that the sick boy wished to meet him

 

Masada says he doesn't believe the case against Jackson is just about money.

 

"Again, I am not judge and jury, but I don't think so," Masada said. "These people, they are very, very nice," he said.

 

Masada said he saw the family a week and a half ago, and that the boy did not look well and has been on dialysis because of his failing remaining kidney.

 

The self-proclaimed King of Pop is free on $3 million bail after being booked on counts of committing lewd or lascivious acts with a child under 14. Jackson is scheduled to be arraigned Jan. 9.

The problem I have with that "no basis for molestation" article is.....things can change. At the time, the mother could have thought the relationship between Michael Jackson and her son was completely normal. Then, her son starts telling her about the stuff Michael actually did to him while he stayed at Neverland. He wouldn't say it on TV because, well, who would admit on national television that he was molested? But he thought he needed to tell his mother. Then, once his mom found out, she immediately decided to go to court, thus changing her entire stance on Michael. Keep in mind: This is a criminal case. Not a civil. At this point, she will not be getting money for anything - so what would be the reason for her and her family to make up these charges? It's possible that they did, but I doubt she would put her cancer-stricken son through a whole web of lies if it wasn't true.

 

Just because the boys and their mother said in February that nothing happened, it doesn't mean that it didn't. The boy could have just not wanted to say anything out of total emabrrassment over the situation, while the mom was oblivious until her son told her.

 

At this point, that memo really doesn't clear Michael Jackson from anything.

Personally I think he's innocent. There's a thing called "Peter Pan Syndrome." I'm not quite suer if it's an official medical term or not, but it is definately a term that has been floating around. Peter Pan Syndrome is what you get when a person is, socially, still stuck in his youth. The social aspect of MJ's mind is still at a young age, so he naturally gets along with young boys much better than he does with adults. Sleepovers for a young boy are merely social events shared between close friends. I do believe that is all that has been going on.

 

After all the hundreds of people who have attended his sleepovers, the number of chilren molested by him is too low if he actually was molesting children. It is my belief that these accusations are simply the result of some child's parents trying to get a chunk of MJ's money.

 

Considering the situation he has set up, and his riches and fame, does it really surprise anybody that one would take adcantage of a situation like that? I doesn't surprise me.

There's something I found rather confusing/stupid/odd...

 

"Michael is innocent," Jackson's mother, Katherine, said in a written statement. "On behalf of the Jackson family we know these vicious lies are totally untrue, malicious and motivated by pure greed and revenge."

 

Most "vicious lies" are untrue, guys. Also, if he's innocent, how could they be motivated by "revenge?" Revenge for what? Vicious and Malicious is usually redundant also--either that, or reminiscent of a WCW tag team.

 

This was a written statement. She didn't have the guts to come out in public and say anything.

I can imagine their whole family is in a bit of a mess and kind of distressed by the whole issue. It's only human to say/write something which may look stupid later when in such a distressed condition.

Pity, then, that in the world outside his mind (i.e. the real one), he's a 45-year-old man sleeping with children not his own, which is creepy at the very least, and very criminal if anything at all else happened.

But when looking at his childhood, can you really blame him? He really had no childhood, his social development never had a chance to continue to develop.

Alright, I know that many of us here used to be young boys. I'm also fairly sure that of those, a fair number slept over at other young boys' houses.

 

So here's my question: When you went to sleepovers at a young age, did you sleep IN THE SAME BED as your young friends?

 

I know I didn't.
