Teen tries to kill girl, to have sex w/her corpse

On Wednesday, Daniel Robbins' stuck by his decision to take responsibility for nearly killing jogger Patty Emanuel and pleaded guilty to attempted deliberate homicide to avoid the pain of a trial.

 

With his parents and little sister looking sadly on -- and his victim sitting quietly in the row behind the prosecution -- the tall, husky 17-year-old with a deep, quiet voice took the stand and acknowledged not only his desire, but also his competency, to make that decision.

 

"It's my choice," Robbins said in response to questioning from his attorney, Steve Hudspeth.

 

That choice could mean the teen spends the rest of his life in prison.

 

Because he was prosecuted as an adult, Robbins faces a mandatory minimum of 10 years, up to life, plus two more years for using a weapon -- his Ram Charger SUV -- to mow Emanuel down from behind at 30 mph.

 

District Judge Kenneth Neill accepted his plea, ordered a presentencing report on Robbins' mental state and other background information, and set sentencing for April 13.

 

There is no plea agreement; the length of time the boy serves, and how he serves it, will be up to Neill.

 

Nine months ago nearly to the day, on May 27, Robbins slammed his SUV into Emanuel, a stranger to him, as she was jogging on a sidewalk near C.M. Russell High School.

 

It was a crime of opportunity, a random attempt to kill her so he could have sex with her corpse, he told police.

 

Missoula psychiatrist William Stratford evaluated Robbins, and has testified in the past that although the teen knew what he was doing and was competent to stand trial, his ability to appreciate what he'd done "was severely impacted due to a deteriorating psychotic mental condition."

 

At sentencing, Hudspeth will argue that the boy's mental condition warrants a departure from the mandatory sentencing minimums.

 

He is hoping to find a way to get Robbins some sort of treatment, rather that straight punishment, although that would have been considerably easier had the case remained in Youth Court. There are few such programs outside the prison system available to adults in Montana.

 

Emanuel, a petite, pretty woman with a shock of wavy blonde hair, spoke briefly with Cascade County Attorney Brant Light after the hearing and left with her son and a few other supporters without commenting.

 

She was hospitalized for 24 days with six fractured vertebrae; four fractures in her pelvis; a deep puncture wound in her chest; a collapsed lung; three broken ribs; a broken nose; sinus fractures in her face; one broken and three chipped teeth, and numerous scrapes and bruises.

 

On Tuesday her attorney, Randy Tarum, called her recovery nothing short of remarkable. He passed on her gratitude for the donations, prayers and kind words sent her way.

 

"She wants to thank the community for its outpouring of support," Tarum said. "It really helped her when she needed it."

 

Emanuel, who married Mark Harant in November, is "back to work now. She's feeling well," Tarum said.

 

"It's been pretty difficult for her, and it continues to be difficult at times, but she's getting along well under the circumstances."

 

Robbins will remain in the Cascade County juvenile detention center until sentencing.

You know there was an actual case similiar to this on Forensic Files. A fat kid who played that Vampire Game ended up killing a pretty woman. The woman had a few month old baby, which he left in the middle of a state park...it was winter so the baby died of exposure. Anyways he took the woman to some random local where he knew she wouldn't be found and had sex with her corpse for 2 weeks.

 

Police only caught him because somebody noticed she went into the store he worked at, police went to interview him and he was wearing cover-up because the woman scratched his face up pretty good in the initial struggle.

 

People can be sick.

Forget probation, I say stick him in a home for troubled teens untill he is 18 years old, then once he turns that age just give him a month of therapy.

 

I'm sure every single one of you guys have had the same urge before, it's perfectly normal in every way.

I don't understand how the assault was stopped. He hit her with the car, and his intention was to kill her and have sex with her corpse, so why didn't he go through with it? She obviously didn't run away with a broken hip. So what stopped it?

I don't understand how the assault was stopped. He hit her with the car, and his intention was to kill her and have sex with her corpse, so why didn't he go through with it? She obviously didn't run away with a broken hip. So what stopped it?

He's 17, and you want to put him in a special home for a few months then let him go?!

He deserves jail time. I don't believe it should be for life, but atleast 5-10 years. He tried to KILL someone for the simple reasoning of having sex with a CORPSE! That is NOT normal, nor would anyone but sick fuckos think of something like that.

no, I think that this is different from the Tate situation which I think is what some are refering to. This guy was 17 years old. At 17, you are for all intents and purposes as close to adulthood as you can get. This guy decided that he was gonna try and kill this women with his car, and then have sex with her corpse. He deserves what he is going to get, and I'm sure some will agree with me that their is a difference as far as maturity between this guy and Tate. So throw the book at him, because I know at 17, you are old enough to be held fully responsible for whatever you do. But at 14, I think a kid deserves some slack because coaching 13 and 14 year olds in summer track, I noticed that some of these kids thought and behaved like children. I say 16 and older you can be tried as an adult.

I think Tate was 12 at the time, actually, but still, I've never in my life met a TEN year old who was too stupid to realize that beating the shit out of six year old was bad.

Hey not all liberals are pansies. This kid needs a good time to think about what he did. And the fact that he appears to have a few issues, yikes. I think 5-10 years with some serious counciling would be nice number to put him away for. That and he wanted to have sex with the corpse, is so wrong on so many levels. And this kid needs help, seriously. But, fortunateley for the girl, she survived. So any mention of death penalty should not be brought up. And this kid looks like he is nut job, and so insanity might be an issue. So I think 10 years locked away is what I think he should get. And while were at it, throw in some serious counsiling, so at least if he wants to go F$%# a corpse, no, there is no justification for doing that.

 

As for the issue with Tate, I think this is case where a much bigger kid decided to emulate the moves he saw on TV. I am guilty of doing that, I am sure many other wrestling fans created their on Fed, and had arguments over who would job, and who would not. But in this case, instead of practicing on kids his own age, he "wrestled" a poor girl to death. So he should be locked up for a time, but not for the rest of his life. I don't think this was a premeditated death. I think Tate is a real big kid, found he could do these moves he saw on TV real easy on a much smaller person. And wrestling takes 1. Knowing what you are doing 2. Your oppenant knowing what he is doing. And in this case, this had "bad idea" written all over it.

 

But, the kid is 14. And I know at that age, you tend to not have the best judgement, and boy did this kid use really bad judgement, and should spend some time in jail. But, to me, I don't think giving him life is a just sentence, fits the crime. I feel that this is more like manslaughter. I don't think that this kid is a homicidal maniac, a bully more like it, but not a cold blooded ki Now if he was much older, and did this, well then I could see the argument to try him as an adult. But at that age you are still a a dumb kid. This is just a really bad example. And plus, he didn't try to have sex with the corpse, so this is no where as demented as the Necrophiliac that this thread is discussing.

It must have been a Kevin Nash match, because there were no actual moves "performed" by this kid. Just punching, kicking, and stomping. A lot of stomping.

Hey I was just throwing out a number. I am not sure what the sentence is normal for this case. If it warrants more years in prison, so be it. But this kid is obvious has many screws loose, and that may be why tried to do this. So let's try this kid, and then complain about whether he got a too lenient or too tough sentence.

 

And your right, Tate's match resembeled a brawl, but my guess, he was emulated what he had seen on TV. I feel that that he should spend time in jail, but at the same time, I feel that he was too young to be tried as an adult. He is guilty, but his sentence was too extreme, IMO. And no way that he should have ever been able to do that to that little girl. Heck, I would even think that time in a real prison, would be justified, but not life behind bars.

Actually, I think Tate's story (which has changed three or four times) now says that he accidently juped on her while charging down the steps from a bathroom break or something.

 

He is guilty, but his sentence was too extreme, IMO. And no way that he should have ever been able to do that to that little girl. Heck, I would even think that time in a real prison, would be justified, but not life behind bars.

 

Anything less affords him the chance to do it again.

I can't agree with the death penalty here because she lived. Life behind bars for attempted rape and murder, though, I can live with that.
