While that's really shitty, $4 mil a piece? Can we pass some fucking tort reform please? If some asshole called me a stupid mic pollock, I'd feel entitled to about $100 and a kick in the nuts. Jesus Christ. Some guy called me a bad name so I never have to work again for the rest of my life! I'm starting to hate this country.

Well, its all about reprecussions. You can feel free to be a racist prick, but if you do it at your job, it needs to cost you. A hundred bucks, and Dennys doesn't give a shit. Hell, a million off their profits is pretty laughable to them. 28 million will get the case to the press and realistically, they know they aren't going to get 28 million. But you don't go in a job interview and say you want to make 10 bucks a hour and expect them to offer you twenty. You high ball them, and you get a settlement for 10 million.

 

Don't hate america because you sell yourself short.

AND what if its not. I mean, its a two way street here. There are plenty of cases of people trying to get money out of a company and plenty of cases of the company being in the wrong. Are you saying do away with lawsuits just incase the company might be innocent?

I do think we seriously need some reform and overhauling of our legal system. The simple fact that you can demand millions of dollars for supposedly being called a dirty name is beyond ridiculous. Look at what all this has done to the medical industry: today's ridiculous costs and insurance rates are directly related to the massive payments often awarded in malpractice suits. Granted, that is a bit different, as a doctor's fuckup can end up killing you and thus deserves more cash, but the point still stands. I think today's "got a problem? sue someone!" mentality is one of the biggest flaws in our country.

I don't. Like it or not, the "sue the shit out of them" mentality has lead to companies actually fearing what the results of ignorance at the work place. Its called reprecussions to your actions. If I speed and get caught, I pay a speeding ticket that arguably is overpriced, and at my income hurts. These lawsuits are the proverbial speeding ticket for a big company. If you bring in hundreds of millions of dollars a hundred dollar fine means nothing to you.

 

And like I said, I can sue a company for 564 bizillion dollars, I know full well that I am not going to get it. Simply saying, if they all sued for a apology, you never would have heard of it. Dennys could continue to have employees that discriminate, and they would pay no reprecussions.

 

This is nothing more than a fine if they are found guilty. Sports players are charged 10's to 100's of thousands of dollars for infractions they cause at their work place (be it berating officials, illegal hits in football, whatever) We are charged fines for wrong doings in our lives, and the price is porportionate to our salaries (ie: 200 dollar fine will really hurt someone making 20K per year).

 

In terms of a huge business like Denny's, 28 million wouldn't put them out of business(not that even if they are found guilty they would even have to pay that much) but it would damn sure make sure they get on the ball and repremand employees that are inappropiate at work (and seeing as this is the second BIG suit against them, apparentlythey didn't learn their lesson the first time).

But Denny's at large can't really be held responsible for the actions of one asshole employee, not to the tune of millions of millions of dollars. And it's not a fine. I'd be more positive about this (but not very much) if Denny's was fined and the money went to charity or something. It's not, these people are greedy little fucks who just don't ever want to work again. Because someone said a mean thing. And it doesn't do anything to the company. They're just going to make the rest of the customers pay.

How about the employee when he gets fired. A company shouldn't have to either defend a bullshit case or have to pay millions of dollars because someone got their feelings hurt. It's just stupid. Complain, the employee will get fired and that's the end of it.

What he said. Do you knowhow many rude and stupid motherfuckers I've dealt with at fast-food places and greasy spoons? The reason many of these people are working there is they're too stupid or antisocial to get a decent job.

It would be different if it was a safety violation and the Denny's burned down, but unless these SPECIFIC guys had SPECIFIC complaints about them, and they did nothing about it should THAT SPECIFIC store be punished, with a fine and perhaps firing of the manager.

When you hire someone, you can't know how they're going to behave at a job. And I haven't to this day seen an insult that's worth that much money. Certain cases of libel and slander sure, but that's way different.

Waffle House is the shit.

 

I hate IHOP. Everything meal they have has pancakes. That's, of course logical, but I don't like pancakes.

Most of these CRAZY HUGE CASES--the ones that even get to juries--get the bulk of their remedies tossed on appeal anyway. Tort reform might be good in some realms, but 90% of the monster verdicts you read about in the news get reduced big-time.

 

More importantly, my favorite Waffle House items, in order of preference:

 

Raisin toast

Pecan waffle

Double hash browns, covered and chunked

In spite of the seemingly countless Waffle Houses I've seen off the interstate in my assorted travels over the years, I've never actually eaten at one.

 

IHOP on the other hand is just up the street from my place and is a regular food stop for me and the lady

like I said, 28 million is a incredibly large amount to US, but to a large business, it is nothing more than a fine. a LARGE fine, but it is a fine when compared to their overall profits.

 

If you don't make incidents such as this costly, what is their incentive to make sure it doesn't happen again?

 

 

 

And Waffle houses chicken is the shit. Its all in that dirty water looking shit they dip it in.

I simply do not like that perceived slights leading to multi-million dollar verdicts. Offensiveness, while bad, should not generate MASSIVE rewards for anybody.

 

And I still say that if they want to raise taxes on the rich -- start by hiking up taxes on contingency fees.

But that would be assuming that the people are getting all the money. I mean seriously, if they DO win this case with each suing for 4 million, they will probably get 1 mill a piece tops, take out lawyer and court fees and they will probably take in low to mid six figures, which, while still alot of money, isn't going to stop them from working the rest of their lives.

I think I'm going to go to Popeye's and sue when I get my cracker ass made fun of by the help there...

 

White people can't sue for being called names silly. We deserve it.

 

And my state has one Waffle House and it looks like they serve food from inside a shack. Cracker Barrel and IHOP's all over the place, but only one Waffle House. That is such bull, when I went to the south about five years back the only place my family and I ate breakfast was Waffle House.

 

But if I need pancakes, give me IHOP. IHOP can make some pancakes, which makes sense since they are designed to only make pancakes.
