http://story.news.yahoo.com/news?tmpl=stor...y_guantanamo_dc U.S. Judge: Guantanamo Suspects Have Rights Mon Jan 31,12:06 PM ET Politics - Reuters By James Vicini WASHINGTON (Reuters) - A U.S. judge dealt a setback to the Bush administration and ruled on Monday that the Guantanamo Bay terrorism suspects can challenge their confinement and the procedures in their military tribunal review process are unconstitutional. Reuters Photo AFP Slideshow: Guantanamo Naval Base U.S. District Judge Joyce Hens Green said the prisoners at the U.S. military base at Guantanamo Bay in Cuba have constitutional protections under U.S. law. "The court concludes that the petitioners have stated valid claims under the Fifth Amendment to the United States Constitution and that the procedures implemented by the government to confirm that the petitioners are 'enemy combatants' subject to indefinite detention violate the petitioners' rights to due process of law," Green wrote. More than 540 suspects are being held at Guantanamo after being detained during the 2001 invasion of Afghanistan (news - web sites) and in other operations in the U.S. war on terrorism. They are al Qaeda suspects and accused Taliban fighters. The ruling pertained to only 50 detainees. Bush administration attorneys argued the prisoners have no constitutional rights and their lawsuits challenging the conditions of their confinement and seeking their release must be dismissed. The tribunals, formally called a military commission, at the base were authorized by President Bush (news - web sites) after the Sept. 11, 2001, hijacked airliner attacks on the United States, but have been criticized by human rights groups as unfair to defendants. At issue in the ruling was the July 7, 2004, order by Deputy Defense Secretary Paul Wolfowitz creating a military tribunal -- called the Combatant Status Review Tribunal -- to check the status of each Guantanamo detainee as an "enemy combatant." The procedures used for the tribunals "are unconstitutional for failing to comport with the requirements of due process," Green concluded. She said the procedures failed to give the detainees access to material evidence and failed to let lawyers help them when the government refused to disclose classified information. The main part of her ruling held the suspects can challenge their confinement and rejected the government's position that all the cases must be dismissed. "Of course, it would be far easier for the government to prosecute the war on terrorism if it could imprison all suspected 'enemy combatants' at Guantanamo Bay without having to acknowledge and respect any constitutional rights of detainees," Green said. "Although this nation unquestionably must take strong action under the leadership of the commander in chief to protect itself against enormous and unprecedented threats, that necessity cannot negate the existence of the most basic fundamental rights for which the people of this country have fought and died for well over two hundred years," Green said. "In sum, there can be no question that the Fifth Amendment right asserted by the Guantanamo detainees in this litigation -- the right not to be deprived of liberty without due process of law -- is one of the most fundamental rights recognized by the U.S. Constitution," she said. Green also ruled that some of the suspects have brought valid claims under the Geneva Convention, the international treaty protecting the rights of prisoners of war. A group of attorneys representing some of the suspects hailed the ruling. "Now it's time for this administration to act," they said in a statement. "Today's decision is a momentous victory for the rule of law, for human rights, and for our democracy." Green's 75-page opinion was the unclassified version and stemmed from 11 cases involving Guantanamo prisoners. Her ruling probably will not be the final word on the issue. A different federal judge in Washington, D.C., on Jan. 19 dismissed the cases of seven Guantanamo prisoners on the grounds they had no recognizable constitutional rights and were subject to the military review process. The cases could be appealed to the U.S. appeals court, and then ultimately to the U.S. Supreme Court (news - web sites). (Additional reporting by Deborah Charles) ---------------------------------------------------------------------------------------- I suppose an arguement could be made that since not all of the detainees are American they may not be subject the rights and rules we do as citizens. But wouldn't it be smarter from a PR standpoint to play by the rules that make us the greatest nation in the world and apply them to even our enemies? It certainly would give critics of the admin. less of a leg to stand on. At this point so many of these assheads have been detained for years and cutting them some kind of deal might finally give us the info we need for a capture/killing of OBL. Hell, anything to push things along. Right? I don't really see the point in being so hardline that it interferes with providing justice for the 9-11 attacks. If it makes them talk by giving them... "something" like a chance to defend themselves in court wouldn't it make sense to do it?

I went a year and a half ago on the Princess Criuseline and had a blast. Its almost worth it just for the food. Cost was about 1200 bucks but since I was number 30 in the list of people that went (it was for a wedding) I got my money back. Whoo! Go with a group.

Yes, and they were wrong. Yet you remain gung ho for a pile of "leaders" who haven't a fucking clue what they are doing? C'mon pop tart even YOU can do better than that. -
Hmmm. I bought it this week and it looks like a US release. Its still pretty damn gory. Anything notable I should expect to have been cut out? The running time on my DVD stands at 109 minutes. Is there a longer version?

I don't and never have given a shit about John Kerry. Find a post where I supported him. Go ahead and look. Thing is, when I put words in the rights mouth it is shit they have already spit. Oh God ye thy name is Hannity. Finally! You can think what you want about the validity of the things I post. I stayed on topic til you Justice tried to make the issue about ME rather than the film. I'll leave the reason up to you. You didn't make it about the film, you made it a cheap potshot! Jesus, bitchign about Rush and wondering "When this guy will be called 'unpatriotic'?" doesn't constitute substance. It was on topic until you brought it onto you obsessive whining about Conservatives calling people unpatriotic! How the hell is your original post even on-topic? Lord, you didn't even pull the 'change the quote' game right because you quoted yourself. I see you read in highlights. You got from it what you wanted. Potshot or not.

I'd imagine that those loggers in the Pacific Northwest would kind of have a problem with weed being made legal again since it would cut into their business. No pun intended. Regardless of the fact that fields of pot are quicker to grow and regrow for things like say... paper manufacturing. Anyone know if the loggers have any big lobbying groups in DC? For me it all goes back to Bill Hicks: "I realised that I could do everything high just as well... I just realised it wasn't worth the fucking effort." and... "Isn't it funny how that the two drugs that do NOTHING for you alcohol and cigarettes, those drugs are legal. But the drugs that make you see how you are getting fucked everyday of your life... THOSE drugs are illegal" So I guess its all about keeping us going to work. See how THE MAN works?

Lord, at least INXS is entertaining. You're just bland. I didn't even hear about this guy until NoCal brought him -- hell, I still don't know his/her name. So, to answer your question, give me another two weeks. By then I'm sure Rush will tell me what to think... Too bad you get all BUTT-hurt when somebody sticks that shitty attitude in your face. Deny it if you like. You know exactly what I am talking about. This guy has made a movie that isn't going to show the war in the best light. So he best brace himself for the shitstorm of fingerpointing that is coming his way. Cuz the smartassed comments I made earlier are very much the attitude and position that those on the right take on topics like this. That bullshit is everywhere. Getting all pissy about it when some light is shown on it only indicates that it struck a nerve. Maybe you both could get Maddog and GreatOne to give a class in clarity and style.

I wonder how long you can go between posts that have a legitmate point rather than simply bitching about Rush all the time. You do plenty of bitching yourself sweetheart.
 -
I wonder how long it'll be before THIS guy gets raked across the coals. I WONDER how long it will be before he gets called "anti-american". How long before he gets accused of putting the troops in danger or inspiring the terrorists? Hmm, his hair IS going grey. "Stupid grey headed liberal elite! Hurry up and get fat so we can punish you for all the years RUSH had to put up with it!"

Where exactly ARE those WMDs again? Maybe it was a hippie/commie/homeless group that hid them so King George the 2nd couldn't find them? Thats about the same attitude. Good job.

Ready for somemore good news? My fathers best friend works for the gas company up here. He has to go to all these meetings all the time with fire chiefs, cops, town officials etc. Last thursday the FBI supposedly showed up to their meeting. What I got from this was that a company called BUXTON OIL had one of their trucks stolen a week ago.. Also their have been 5 garbage trucks stolen in the past month or so. Don't know much more about it, but the Feds were REAL interested in finding if their is a link. -
I'm often surprised that the radio types that harp on and on about the liberal media don't back track ( Moreso when they called on their shit)as merely identifying members of newsrooms, anchors, reporters, etc as what they are talking about when picking out who these liberals are. Instead of that we get this overcast statment that ALL media is liberal leaning. Which IS what they want you to THINK. Cuz afterall, everybody loves an underdog, right? Why not play up the idea that conservatives are being opressed by a liberal agenda as motivation to get them to the ballot box? Politics of fear anyone? Then when they get an idea or something they can't argue with, its "not in the mainstream". All of a sudden there is a mandate, and its a conservative world and everyone else is going against the grain. Say what you want about CBS, Rather, etc. but its is the liberals who are outnumbered as they get the LEAST opportunity to talk their shit.

New Hampshire has always been known as the Anti-Massachusetts. since there is no sales or income tax so many of the baby boomers have moved and turned it into a blue state. Thats ok, they get it in the ass on the property tax though. I don't fit with the politcal leanings here even with the change. -
	I feel the same way.

I may be wrong, but I think he was talking about Fat Mike from NOFX.... Hes obsessed with big lesbians and has been a punk rocker for most of his life. I'm pretty sure it's all about Michael Moore. How long into 2005 did it take for the first "Mikey is fat" joke anyway? Round here, if one didn't happen I would think something was wrong.

Funny, I like The Final Cut as its my favorite PF record, but I don't care for Waters solo work.

Not even close to Emo. They (Nashville Pussy) are kind of a beer drinking, AC/DC type of garage band. They destroyed everybody from the 2nd stage of the Tattoo the Earth show I went to at Suffolk Downs in Boston. They ain't emo.
