This is extraordinarily wrong.  Jingus is right on this.  A pot charge isn't a death sentence, nor should it be.  This man didn't have to die for that.  This man shouldn't have died like this.  It's inexcusable.

As someone from Maryland, who isn't from Baltimore, and therefore says "DC" when asked where he's from, I truly know where you're coming from. ;)

Why should the judge be charged? He didn't kill this man, the cops did.

Probably because he should have went to a hospital prison--a place that could meet his requirements for living. Sending him to a pen was an awful lapse in judgment, and a decision that caused someone's death.

 

I don't know if he should be formally charged with a crime, but he needs at least a slap on the wrist, maybe even a demotion if such a thing exists for judges.

Hmm, another example of why people facing their first charge for simple drug use shouldn't go to jail.

 

Let's not lose focus on the real issue here: this guy didn't die because he smoked pot, he died because the prison didn't have the means necessary to keep him alive. In that case, who the fuck sends the man to prison? You send him to a hospital prison, or you give him a fine for smoking the wacky tobacky and move on. There's a lot of blame to go around here.

The fact that he was even sentenced to jail time is enough alone to question the sanity of the judge, and the fact that he wasn't provided with a machine that you know, kept him breathing, should result in criminal charges. 

 

Are you telling me the judge couldn't have reversed his decision upon finding out the jail was not equipped to accomodate a quadriplegic.

And that he could smoke pot WHILE using a ventilator has a weird stink to it.

I really don't want to flame-bait, but it seems like I have no other choice...

 

You know, Mike, there are such things as "Hospital Prisons." If you were as smart as you tell everyone you are, you would have known that.

Which, shockingly enough, does not exactly explain how somebody on a ventilator CAN BE SMOKING POT.

 

Quite frankly, if you smoke while on a ventilator and die --- look in the mirror, you fucking moron.

[EDIT]-Also, Mike, some people who are terminally ill or are so fucked up physically are usually in so much pain, that it takes a shitload of drugs to take it away. When I blew out my knee about a year ago, the Dr. prescribed me some ibuprophen that was three times stronger than the OTC stuff, and it was still pretty sensitive to pain. Why don't you stop and think about other people's suffering every once in a while, huh?

This entire argument is negated by the fact that he could have been cooking the marijuana and ingesting his THC that way, rather than smoking it, which I didn't realize until after I posted.

 

He was charged for POSSESSION, no paraphernelia charges or drug use charges.

Drug use on the level of cocaine, heroin, acid, I can understand. But smoking marijuana is a pretty victimless crime, with the exception of the person inhaling carbon dioxide or if they go out driving while high. Like I stated, I don't feel any safer if someone who was using marijuana is in jail or not, which I would suppose is the point of prison in the first place (that and reformation, I'd guess)

No. He died from something stupid the judicial system did - not anything HE did.

 

For the record, I suppose it's also possible he was using a vaporizer on his weed, (which'd make sense to me, since it's supposed to be like, smoke-free that way or something) but like others have mentioned, that really shouldn't matter. The fact of the matter is, he was sent to a jail that couldn't keep him alive, and died as a result.

 

That's SOMEONE'S fault, but not the cripples'.

Because some important people almost lost a LOT of money.

 

There's a whole conspiracy theory on the issue, but this probably isn't the place for it. Do some searching on William Randolph Hearst and his connection to it - shouldn't be too hard to find.

That and there is no way to control the secondary buzz which means various people could get arrested for driving under the influence just because they were around someone who had been smoking it at the time.

 

As for why it's not legal for medical use....I have no clue on that one.
