I Got Arrested Last Night

So last night I went to the bar with my friend Kelly. She proceeded to get fucking HAMMERED and handed me her keys. While taking her back to get my truck, she was in the process of either passing out or falling asleep, so I decided not to let her drive back to her house, which is 20 minutes away. We went and got my truck, as I was going to have her sleep on my couch when I got nailed by an Ohio County sheriff.

 

He gave me the standard "follow the pen" test as well as having me walk heel-to-toe and then balance on one foot for 30 seconds. Well, I only made it to 28 after doing fine on the first two tests. then he said "Please face my car, sir." at which point I knew it was over. He had me do the breathalizer, and I blew a .09, at which point he cuffed me.

 

Now, if I would have let my friend drive home, she'd be fucking dead right now, no doubt about it. I know what I did was wrong (drinking and driving), but I also think what I did was right (not allowing her to drive). But I wonder now what I'm going to face as far as court goes. I've never been arrested before, nor have I ever had a DUI. Has anyone on this board had one, and if so, can you help me out, as far as court and the like goes?

Right now I have only limited use of my left leg and had to leave the Navy because a seventeen year old girl, in a situation strikingly similar to your own, crashed into my car by taking a right on a red at 45 miles an hour. (If I recall correctly her breathlizer was .08)

 

Get a cab next time.

Cerebus' post was more level headed than mine, yet he had far better reason to tear this guy a new asshole. Weird.

 

I've noticed the ones who have been involved in the bad side of the situation are always much calmer than those of us who haven't been placed in the situation.

 

And yes, get a cab next time. If you have been drinking, you don't drive. There is no reason to do it ever.

I don't know what state you live in, but here's info on what happens for a first offense in my state.

 

Penalties for DUI in Nevada

 

The penalties for driving under the influence depend on whether one has had a DUI conviction within the past SEVEN (7) years. This calculation is made based on the time between the date of the prior arrest to the date of the current arrest.

 

CONVICTION: A person that pleads no contest, pleads guilty or is found guilty at trial is subject to the following judicial penalties:

 

DUI FIRST OFFENSE:

 

JAIL: 48 hours up to a maximum of SIX (6) months imprisonment, or, at least NINETY-SIX (96) hours of community service. The court may allow you to do community service in lieu of the mandatory jail time.

 

FINES AND ASSESSMENTS: A minimum of THREE HUNDRED FORTY DOLLARS ($340.00) to a maximum of ONE THOUSAND ONE HUNDRED SEVENTY-FIVE DOLLARS ($1,175.00) (fines and assessments).

 

SUSPENSION OF DRIVING PRIVILEGES: A criminal conviction for a First Time DUI results in a NINETY (90) day suspension of driving privileges. After FORTY-FIVE (45) days you may obtain a restricted driving license, to drive to and from work.

 

OTHER PENALTIES: The Court will always impose the requirement that you attend an EIGHT (8) hour course of DUI school, a DUI assessment program with a ONE HUNDRED DOLLAR ($100.00) fee if the blood alcohol is .18% or more, and a Victim Impact Panel with a FORTY DOLLAR ($40.00) fee. The court may also order a Breath Interlock Device be attached to your vehicle (at your expense) for THREE (3) to SIX (6) months.

 

I hope you get through this and thankfully nobody was hurt.

I got a DUI in October of last year. It basically boiled down to me having to pay a little over $500 in court costs (if you have the money outright, don't get a public defender because there isn't anything genuinely helpful that he/she can do for you and it'll cost additional money) and I lost my license for a year. I also have to take 30 hours of alcohol education classes before applying for a new license, which will end up costing $300. I had a few extra things going against me, though, in that my BAC was really high (I blew a .17) and I was under 21 at the time of my arrest. My only saving grace was that I had no prior convictions on my record, so I'm sure you'll benefit from that as well. On the plus side, I got a pretty amusing anecdote out of the whole ordeal and record-high gas prices don't phase me at all.

 

Edit: Oh, I also had to do 24 hours of community service, which was a total pain in the ass.

I have a feeling that if you would have seen this site before last night, you wouldn't have even considered driving under the influence.

Yeah, I really think that drunk driving convictions should come with heavier penalties. For instance, I would be more than willing to give up certain rights of my own if all drunk drivers were stripped of the right to hold public office and this law was enforced retroactively.

Seriously though, I have no tolerance for something as reckless as drunk driving. You might have thought you were doing the right thing, but in reality you were just as impaired and are lucky you didn't hurt anyone, including yourself and your friend. Either call a cab or designate a sober driver to come pick you up.

Driving is a privelage not a right, I would have no problem with the penalty for a DUI being a revokation of license. Permanently.

Take it easy. I'd say a large majority have driven home when we were on the cusp of blowing over the limit. Sloppy drunk people are a different story. This cat made a mistake, hopefully it won't be too stiff.

I blew a .27 once, and had two drunk underage girls in the car with me. And just because I joked with, and was nice to the cops, they had me sober up for around a half hour (which didn't work of course) and then let me go. I learned no lesson whatsoever.

 

Ooooh baby baby, it's a wild world.

You are the kinda guy who deserves to be locked up. What that cop did was totally irresponsible, you know that right? He's putting everyone else in danger by doing that. But someone who blows slightly over gets the book thrown at them? its stupid.

Well there were two cops, and yeah, completely irresponsible and stupid. There's also the time I got pulled over and got away with it because of the "Volunteer Firefighter" sticker in my window. Don't blame me, I stopped driving altogether. Blame the idiot cops.

 

Also, Nanks, maybe if you get your fat ass out of that computer chair here and there, you might have some stories too. Sunlight never killed anyone buddy.

Fat ass??? There's a picture of me right there. I've got stories, they're just not as cool as your tales of recklessly endangering the lives of yourself and others with stupid and pointless illegal activity.

 

Yes, the cops are stupid. But not as blindingly stupid as you for driving that drunk, especially with other people in the car. You're pushing shit uphill on this one champ, you're not going to find a whole lot of support.

Well I learned from my mistakes and stopped driving completely. Everyone makes mistakes. I just don't enjoy the air of superiority I am feeling here. Banky summed it up best when he said, (adlibbing here) "Everyone has gotten behind the wheel drunk at some time or another." If that's not the case with you, then I just lack the moral fiber you seem to possess. How is the weather up there on that high horse by the way? In the end, I never hurt anyone except myself by driving drunk, so let's not live in a world "Could'ves", okay?

Actually, this is what Banky said. Yeah, I've definitely driven when around the .05 zone but to make use of the reference you've used, there is a big difference between being on the cusp of the limit and being sloppy drunk. If you blew .27, you were sloppy drunk, I don't care how much you drink, I've blown .45 (nowhere near a car) I know what point you were at, at that BAC it's not a matter of how well you hold your booze. Banky also went on to say you should be locked up, I don't think he's your greatest ally in this situation.

 

The worst thing about your story is you didn't tell it in a regretful way as if it was a terrible mistake you're ashamed of, you seemed to think it was somehow cool that you'd blown such a high reading when you had other people in your car. That being said, you seem to be backpedalling on that now.

I don't tell it in a regretful way because I don't regret it. Nothing bad happened to anyone, and I got away with something. Boom, happy ending. Also, I chugged a beer before I walked out the door, which probably made my BAC much higher.

The point at hand isn't whether or not "you get away with it", it's the callous attitude towards the safety of others that is of concern. Chugging a beer on the way out would have brought you up from .20 at the very lowest. So yeah, you were at least 4 times the legal limit and had the lives of two other people in your hands (excluding other people on the road) and you don't seem to see the problem with that.

Actually it's an air of people being pissed at you for being so stupid and reckless that you even thought that once was ok. Then you told a brief version of a second story in which you've driven drunk. This isn't a case of you not knowing it was stupid either, because everyone in the civilized world knows that it's illegal and moreso wrong.

Too bad that you aren't a victim here, asshole. So stop trying to get the dogpile to lay off. You deserve every harsh word directed at you for this, and more. Frankly, you deserve an ass whooping for this but hey, that's not for me to threaten or decide.

 

Everyone here has driven home on a friday after a pop or two I'm sure. Some people, however, know how to have a drink or two and then hang out for an hour or two before hopping behind the wheel. Unless you're a complete lightweight then you're really not gonna cause any trouble. Some people are just smart like that.

 

Maybe you should think about one or two could haves. Then maybe the idea that drunk driving and talking out of it could get drilled into your head.

 

Better that then you drilled through a sign post when thrown from a rolled car. Or driving over a kid on a bike.

Um yeah, I thought about em, they're in the past, and I don't drive anymore. Have you guys missed that part? And what about the part where no one was killed or injured? And what about the part where the two girls willingly got into the car with me? Their safety is on them at that point, isn't it? i got them to the door safe and sound, which may not have been the case if they called up someone else for the ride.

 

Tonight I am supposed to go to a party in Philly. Know what I am doing? Taking a train there, then either sleeping over (if I get lucky) or taking a cab home.

 

You're basically yelling at someone who already learned their lesson. It's like if you catch your kid playing with matches, they never touch em again, then you yell at them again 2 years later.
