The mother appealed the June 12 expulsion to county court. She alleged the district violated her daughter's constitutional rights and was not clear in its written policies that oral sex on a bus was unacceptable behavior. Judge George E. James disagreed, ruling that the expulsion was legal and was supported by substantial evidence. James upheld the disciplinary action and denied the appeal. School administrators suspended the girl and a seventh-grade male classmate, also 13, for 10 days on May 19 after several other pupils reported that the pair had oral sex that day on a bus while returning from a field trip to Independence Marsh in Independence Township. The Times is not identifying the children or their parents because of the nature of the case. Both children admitted to middle school Principal Thomas Ralston that they had consensual oral sex on the bus in front of other pupils. During an expulsion hearing June 2 before the school board, the girl said her behavior was the result of peer pressure. According to a transcript of the proceedings, the girl said that before leaving the marsh, she and another girl had discussed performing oral sex on the boy, and the other girl said they should do it. "She said because she thought it would be cool and she thought all of her friends would look up to us," the girl told the board. On the bus, the second girl tried to get a second boy to let her fondle him, the expelled girl said. Meanwhile, the girl who was expelled was sitting next to the first boy. She said several other boys sitting around them began egging them on, one calling them chicken and other names, and another saying he wanted to see some action. "Then I looked at (the boy) and said, 'Well, what are we supposed to do?' and he said we were going to lose our friends if we didn't," the girl said. Neither the bus driver nor two chaperones noticed what was going on. Administrators learned of the incident after several pupils told a guidance counselor, who reported it to Ralston. When confronted by Ralston, the girl and boy were remorseful and ashamed about what happened. Prior to the incident, neither child had been disciplined at school. Both were expelled until Oct. 29. They were offered admission to the school district's alternative-education program and can be reinstated to mainstream classes as long as they comply with the conditions of their expulsion. They also have to be examined by the school's student assistance team to determine whether they should be referred to the county's mental health agency for counseling. If they are referred, they must complete the counseling. They also are banned from all school functions during the expulsion. Phone calls placed Tuesday from The Times to the parents of both children; Kurt Winter, the attorney for the girl's mother; and Diane Z. Buchanan, an attorney for the school board, were not returned. The "peers" need to be set as an example as well for not having this shit done again. I mean, we get deaths in school from obsessive bullying (which probably would've happened to these two from their "friends"), do we have to start worrying about sexual conduct in ELEMENTRY? My bus route was particularly rural, and the driver was nearing her 80's, and was deaf as a post. Her other senses were extremely dull, and it was all her tiny birdlike frame could do to keep that yellow beast from careening off into a ravine, bless her heart. We weren't standing in the seats sippin' whiskey and pitchin' pennies or anything, but all kinds of kids would take a few drags off a cigarette, or what have you. The farm kids would dip and spit in a bottle they kept in their bookbags. They have cameras in those busses now though, so I suppose the kids don't get away with as much. I am only 18 and i thought that when kids in my grade were having sex in 9th grade that it was nuts. Shit, when I was in 7th grade we didnt even think about pulling off shit like getting head in the back of the bus. It seems like we were the last group of kids to actually act like kids at that age, we were more worried about the latest final fantasy game than getting brain on the bus. My sister is in 8th grade and my brother is a freshman in high school and even though I am just 5 years older the generation gap seems large even though for the most part we are the SAME generation. Its just that when the whole "Britney Spears, Christina Aguilera, Thong Song, booty shakin bitches in videos" era came along i was already like 15 and not as influenced by it as say kids who were 9 and 10 years old at the time. I mean my sister has friends who seriously hit on me and im a legal adult. It seems like parents have completely lost control of their children and tend to let them do what the hell they want. I saw a girl at a basketball tourney i was playing in going into my senior year of hs and she couldnt have been older than 12 and she was dressed like a total slut. I mean thats a harsh thing to say about a sixth grader but its the truth. Girls and boys too are growing up at alarming rates. 12 year old girls dress like they are 18 , 15 year girls dress like they are 21, and 18 yr olds dress like how they should because they are fucking adults. Sex ed is taught to 5th graders now. Porn is readly available to anyone on the internet and parents pay little attention to what their children are looking at. I will say that I am sure no kid said "Look, I can see Britney Spear's navel...I want to go suck a cock now!". The knowledge of sex is greater and it has been before some PG-13 rated video on MTV came along. Everytime something happens now, it is pop singers fault somehow. The most you can see is probably the head of the student sitting, and probably even less. If somebody leans down and starts sucking, it can be done very easiliy with a driver or a chaperone seeing (as they are usually at the front of the bus). As for people kind of crowding and cheering and stuff, that kind of stuff happens on every single school bus in america (i'm talking about the crowding, noise, etc, not the oral sex, although taht happens also). Dames Dude, I NEVER got away with anything in the back of the bus when we went on field trips. My stupid teachers actually WERE smart back in ele and had a supervisor in the back, and in the middle and in the front to keep close tabs on us. Heck, even our bus driver was watching us on the normal trips. And could catch us pulling something off (and no, nothing like that, honest >_>) in the back. Then again, he knew us all (I lived in a town with only 2000 people in it when I was in ele) so he knew when we were up to something. Still though, geezus... At least one of the trips was a band trip in which a guy got a blowjob from a freshman or sophomore girl and nothing would have happened if a particularly highstrung senior girl hadn't freaked out after the trip was over (she had also freaked out after a football teammate of mine had exposed himself, which resulted in him being enrolled in another school by the end of the day, and she wasn't well liked to begin with, so she REALLY wasn't popular afterwards). There was a bunch of other stuff like this as well. On a week-long trip to Texas, a classmate of mine "borrowed' the camera of a girl he didn't like and took some candid photos, which shocked the hell out of her and her parents when they came back from the photomat. He got suspended for a week then said "fuck it" and decided to go elsewhere. One girl in my class who had some emotional issues dealt with them by having all kinds of sex, including blowing about half the guys in my class over the course of five years (not me, although that's a GOOD thing considering another story which I won't tell because I'm eating now). A girl I know gave a guy a handjob while on the way to a band competition, another guy I know got suspended for a few days because he was fingering his girlfriend discreetly on a couch in the student center, etc. etc. etc. This doesn't even go into the two girls from my class who got caught on film eating at the Y while on an ROTC trip. Granted, this is considered to be a "high end" private school. The photographer mentioned earler, a star athlete, managed to get himself and two teammates kicked out of a private school that would take ANYONE because the three of them were found tag-teaming some underclassmen girls. Teens were having sex for many generations. This dilema wasn't created by rap music or hip hop or britney. Only thing Britney and Christina do are influence fashion. I just think now that more people know about everything and the sexual stuff is more out in the open it comes as more of a shock, because it was always hush hush back in the day, but that doesn't mean it wasn't going on.
