But authorities contend his alleged weapon of choice wasn't a gun or a knife, but a virus. The 48-year-old has become the first person in Canada ever charged with first degree murder as a result of spreading HIV. The Crown alleges Aziga sexually assaulted at least 13 women in a three year stretch from 2000 to 2003. Of those, seven developed the virus that causes AIDS, and two died. The first victim succumbed to the disease in December 2003, while the latter died last May. Authorities contend he knowingly spread the infection without telling his partners of the risk. Aziga had originally been charged with aggravated sexual assault in the cases, but the deaths upped the ante and the government decided it needed to send a message to others. Legal officials have asked Health Canada to help in their search for evidence, in an effort to prove the charges. The accused, who was born in Uganda but moved to Hamilton, was in a courtroom on Wednesday to face the upgraded accusations, but abruptly delayed proceedings by firing his lawyer. A judge has given him two weeks to find a new attorney. The case returns to court on March 11th. SOURCE When I first saw this, I thought that it was a little harsh for first degree murder, since he didn't intend to kill them, even though his actions did. I did not however, see that he sexually assaulted them, against their own will, thereby making it MUCH worse. He's a terrible person if it was consentual, if it was assault than he's a piece of shit. There are a lot of shades of grey with this case though.

Ripper Posted February 25, 2005 Report Posted February 25, 2005 I don't know....if you know you have aids and you get people to have consentual sex with you to give it to them and they die, that is kinda first degree murder. I mean, its premeditated, and your actions could lead to their death.

If the spread of AIDS is ever going to stop, it's going to take some harsh punishments levied on people like this who are basically armed and dangerous conspiracists, as far as I'm concerned. There's also the need for more education, but you'd be surprised, especially among gays, that there's an ever-growing segment of the community that has decided to live without fear and bareback, along with another growing segment of the community that sees AIDS as a "gift" because they get to die young, and they want to share that gift with as many people as they possibly can. I want to shoot them.

If he's knowingly spreading the disease to people against the will, he's doing every bit as much damage as someone who rapes somebody and then puts a bullet in their head. If they can think of a more painful death than AIDS, well he deserves it.

In Canadian Law, if someone dies as a result of a one of a specific offenses (sexual assualt is one of them, as is robbery), then it is an automatic first degree murder charge. Three things have to be proven here in Canada. 1) He is guilty of sexual assault. 2) He was HIV positive. 3) They are now HIV positive as a result of the sexual assault. If all three are true, then he's guilty of first degree murder. At least when they die. I'm not sure what will happen before then. He'd probably be ruled a dangerous offender anyways.

Pull his medical records and find the day he was first diagnosed with AIDS. If he came in for follow-up visits, he had to know. I'm curious if this case would be handled the same way in the US that it would be in Canada. Sounds like a HIPAA nightmare waiting to happen.
